Written over the past twenty years, these essays examine the 'dark side' of functional differentiation and the prospects of societal constitutionalism as a possible remedy. Multinational corporations have violated human rights; private intermediaries in the internet have threatened freedom of opinion, and the global capital markets unleashed catastrophic risks. All of these phenomena call for a response from traditional constitutionalism. Yet it is outside the limits of the nation-state in transnational politics and outside institutionalized politics, in the 'private' sectors of global society that these constitutional problems arise.  It is widely accepted that there is a crisis in traditional constitutionalism caused by transnationalization and privatization. How the crisis can be overcome is one of the major controversies of modern political and constitutional theory. This book sets out an answer to that problem. It argues that the obstinate state-and-politics-centricity of traditional constitutionalism needs to be counteracted by a sociological approach which, so far, has remained neglected in the constitutional debate. Constitutional sociology projects the questions of constitutionalism not only onto the relationship between public politics and law, but onto the whole society. It argues that constitutionalism has the potential to counteract the expansionist tendencies of social systems outside the state world, particularly of the globalized economy, science and technology, and the information media, when they endanger individual or institutional autonomy.  The book identifies transnational regimes, particularly in the private area, as the new constitutional subjects in a global society, rivals to the order and power of nation states. It presents a model of transnational, societal constitutional fragments that could bring the values of constitutionalism to bear on these private networks, examining the potential horizontal application of human rights in the private sphere, and how such fragments could interact. An original and provocative contribution to the literature on modern constitutionalism, Constitutional Fragments is essential reading for all those engaged in transnational political theory.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":50528606388497,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ LIKE_NEW \/ INTERNAL","offer_id":50528606781713,"sku":"GOR013986586","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ VERY_GOOD \/ INTERNAL","offer_id":51464048804113,"sku":"GOR014290425","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52332907069713,"sku":"NLS9780199644674","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/0199644675.jpg?v=1750812592"},{"product_id":"nach-jacques-derrida-und-niklas-luhmann-zur-un-moeglichkeit-einer-gesellschaftst-book-gunther-teubner-9783828204430","title":"Nach Jacques Derrida Und Niklas Luhmann: Zur (Un-)Moeglichkeit Einer Gesellschaftstheorie Der Gerechtigkeit","description":"Gegenuber der aktuellen sozial- und rechtsphilosophischen Debatte zur Gerechtigkeit, die zwischen den Polen der Universalitat und der Alteritat oszilliert, arbeiten die Autoren des Bandes eine dritte, eine sozialtheoretische, Argumentationslinie heraus. Ausgangspunkt sind die Paradoxien des Rechts, wie sie von Jacques Derrida und Niklas Luhmann formuliert worden sind. In Luhmanns Kontingenzformel des Rechts erscheint Gerechtigkeit nicht primar als philosophische Frage, sondern als konkrete Praxis der jeweiligen Selbstbeschreibungen des Rechtssystems, welche die bloe Konsistenz des Recht ubersteigt und sich an den Anforderungen der Umwelten des Rechts orientiert. Die Autoren des Bandes konfrontieren die Luhmannsche Kontingenzformel mit dem Gerechtigkeitskonzept von Derrida, die auf eine Transzendenz des Rechts in ganz anderer Richtung zielt. Diese ist fur die Rechtsoperationen prinzipiell nicht erreichbar, ihren Anforderungen aber sind sie standig und ohne Ausweichmoglichkeit ausgesetzt. Was ergibt sich aus dieser Konfrontation fur die Neuformulierung von Grundbegriffen des Rechts: Gerechtigkeit, Rechtssubjektivitat, subjektives Recht, Rechtsgenese, Rechtsargumentation?","brand":"WoB","offers":[{"title":"- \/ - \/ INTERNAL","offer_id":52482709553425,"sku":null,"price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ INGRAM","offer_id":52482710765841,"sku":"NLS9783828204430","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783828204430.jpg?v=1759853632"},{"product_id":"constitutional-fragments-book-gunther-teubner-9780198713951","title":"Constitutional Fragments","description":"In recent years a series of scandals have challenged the traditional political reliance on public constitutional law and human rights as a safeguard of human well-being. Retail franchises are one such example of a network, but the most common instance is a credit card transaction between a customer, retailer, and the issuer of the card.  How should the law analyse this hybrid economic phenomenon?  It is neither exactly a market relationship - because that overlooks the co-ordination, relational qualities and interdependence of the contracts - nor is it a type of business association or company, since it lacks a centralised co-ordinating authority that receives the residual profits.   This book is a translation of Gunther Teubner's classic work on networks, setting out his novel legal concept of 'connected contracts'.  In it he explains how this concept addresses the problems posed by networks, such as the question whether the network as a whole can be held legally responsible for damage that it causes to third parties such as customers.  A substantial introduction by Hugh Collins explains the analysis of networks in the context of German law and the systems theory from which Teubner approaches the topic.  The introduction also explores how far the concept of connected contracts might assist in the common law world, including the UK and the USA, to address the same problems that arise in cases involving networks.  As well as making a contribution to comparative law and legal theory, the book will be of interest to scholars interested in contract law, commercial law and the law of business associations.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52584240414993,"sku":"NLS9781849461740","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9781849461740.jpg?v=1761049466"},{"product_id":"juridification-of-social-spheres-book-gunther-teubner-9783110111378","title":"Juridification of Social Spheres","description":"No detailed description available for \"Juridification of Social Spheres\".","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52599859609873,"sku":"NLS9783110111378","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783110111378.jpg?v=1761087545"},{"product_id":"autopoietic-law-a-new-approach-to-law-and-society-book-gunther-teubner-9783110114591","title":"Autopoietic Law - A New Approach to Law and Society","description":"No detailed description available for \"Autopoietic Law - A New Approach to Law and Society\".","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52650855334161,"sku":"NLS9783110114591","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783110114591.jpg?v=1762129023"},{"product_id":"dilemmas-of-law-in-the-welfare-state-book-gunther-teubner-9783110104950","title":"Dilemmas of Law in the Welfare State","description":"No detailed description available for \"Dilemmas of Law in the Welfare State\".","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52664135418129,"sku":"NLS9783110104950","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783110104950.jpg?v=1762273829"},{"product_id":"environmental-law-and-ecological-responsibility-book-gunther-teubner-9780471949862","title":"Environmental Law and Ecological Responsibility","description":"In the last decade, both lawyers and social scientists have begun to take a rather sceptical view of the potential of direct outside intervention as a means of controlling the environmental impact of commercial organizations. Instead, the encouragement of these organizations to establish processes of internal self-regulation to monitor, control and replace economic activities injurious to the environment has become the favoured route for resolving the conflict between business priorities, legal obligations and environmental management concerns. This volume discusses the achievement and potential of ecological self-organization as a means of managing the environmental challenges confronting business, commerce and industry. Although primarily written from a legal viewpoint, the wider community concerned with the interface between environment and business will also benefit from the book.","brand":"WoB","offers":[{"title":"- \/ - \/ INTERNAL","offer_id":53072963797265,"sku":null,"price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ VERY_GOOD \/ INTERNAL","offer_id":53072963895569,"sku":"GOR014728236","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9780471949862.jpg?v=1769632086"}],"url":"https:\/\/www.worldofbooks.com\/collections\/author-books-by-gunther-teubner.oembed","provider":"World of Books ","version":"1.0","type":"link"}
