This revised edition provides important updates on each area covered, including new case law; institutional developments; and EU legislation. These changes are located within the framework of broader developments in the EU.   The chapters in the first half of the book deal with all the principal variants of the EU administrative regime. Thus there are chapters dealing with the history and taxonomy of the EU administrative regime; direct administration; shared administration; comitology; agencies; social partners; and the open method of coordination. The coverage throughout focuses on the legal regime that governs the particular form of administration and broader issues of accountability, drawing on literature from political science as well as law.  The focus in the second part of the book shifts to judicial review. There are detailed chapters covering all principles of judicial review and the discussion of the law throughout is analytical and contextual. It begins with the principles that have informed the development of EU judicial review. This is followed by a chapter dealing with the judicial system and the way in which reform could impact on the subject matter of the book. There are then chapters dealing with competence; access; transparency; process; law, fact and discretion; rights; equality; legitimate expectations; two chapters on proportionality; the precautionary principle; two chapters on remedies; and the Ombudsman.","brand":"WoB","offers":[{"title":"GB \/ VERY_GOOD \/ INTERNAL","offer_id":49551943008529,"sku":"GOR010867137","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52516107583761,"sku":"NLS9780198831655","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":52734571217169,"sku":"NIN9780198831655","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/019883165X.jpg?v=1750694488"},{"product_id":"eu-law-and-the-welfare-state-book-grinne-brca-9780199287413","title":"EU Law and the Welfare State","description":"This collection of essays addresses a topical subject of current importance, namely the impact of the EU on national welfare state systems. The volume aims to question the perception that matters of social welfare remain for Member States of the EU to decide, and that the EU's influence in this field is minor or incidental.   The various essays trace the different ways in which the EU is having an impact on the laws and practices of the Member States in the area of welfare, looking at issues of social citizenship and the influence of the Charter of Fundamental Rights, as well as at the impact of EU economic freedoms - competition law and free movement law in particular - on both 'services of general economic interest' and on national health-care systems. The significance of the so-called Open Method of Coordination in developing a new compromise on 'social Europe' is discussed, as well as the tensions between market liberalization and social protection in the specific context of this transnational political system are examined.   While the various authors clearly have different views on the likelihood of a robust form of European social solidarity developing, the book as a whole suggests the emergence of a distinctive, although partial and fragmented, European Union welfare dimension.","brand":"WoB","offers":[{"title":"GB \/ VERY_GOOD \/ INTERNAL","offer_id":49576071102737,"sku":"GOR006571834","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ INGRAM","offer_id":52619374723345,"sku":"NLS9780199287413","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/0199287414.jpg?v=1751434332"},{"product_id":"reframing-human-rights-in-a-turbulent-era-book-grinne-brca-9780199246007","title":"Reframing Human Rights in a Turbulent Era","description":"In recent years, human rights have come under fire, with the rise of political illiberalism and the coming to power of populist authoritarian leaders in many parts of the world who contest and dismiss the idea of human rights. Or are they more appropriately seen as 'principles' to be promoted as and where appropriate?  The contributors to this volume argue that international agreements and institutions are of central importance if labour rights are to be protected in a globalized economy. But the report cards they give to the World Trade Organization, the European Union, NAFTA, and the Free Trade Agreement of the Americas are generally very critical. While there is a strong rhetorical commitment to labour rights, at least on the part of the US and the EU, the substance of what has been achieved to date is hardly impressive. In so doing, it discusses these issues from a variety of perspectives - legal, economic and political - reflecting the different dimensions of the enlargement project. This enlargement will be unlike any other, not only in terms of its scale, and the unprecedented nature of the lengthy and complex pre-accession process, but also in its wider implications for the future direction of the European Union itself and for the whole of Europe. The contributions thus focus not only on the adjustments having to be made by the candidate States and the EU's institutions, but also on enlargement as an interaction between the candidate States and the European Union, and between the EU and the wider world community. Policies which have developed and matured during this enlargement, such as conditionality, also have effects on regions and States which are outside the current enlargement process, such as the Balkans.","brand":"WoB","offers":[{"title":"GB \/ VERY_GOOD \/ INTERNAL","offer_id":49613417316625,"sku":"GOR002964124","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52486302531857,"sku":"NLS9780199260942","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/019926094X.jpg?v=1751259033"},{"product_id":"human-rights-intervention-and-the-use-of-force-book-philip-alston-9780199552726","title":"Human Rights, Intervention, and the Use of Force","description":"The imperatives of sovereignty, human rights and national security very often pull in different directions, yet the relations between these three different notions are considerably more subtle than those of simple opposition. Human rights activists increasingly address the activity of multinational corporations, the policies of international organizations such as the World Bank and the World Trade Organization, and international crimes committed by entities such as armed opposition groups and terrorists. This book presents an approach to human rights that goes beyond the traditional focus on states and outlines the human rights obligations of non-state actors. Furthermore, it addresses some of the ways in which these entities can be held legally accountable for their actions in various jurisdictions.  The political debate concerning the appropriateness of expanding human rights scrutiny to non-state actors is discussed and dissected. For some, extending human rights into these spheres trivializes human rights and allows abusive governments to distract us from ongoing violations. For others such an extension is essential if human rights are properly to address the current concerns of women and workers. The main focus of the book, however, is on the legal obligations of non-state actors. The book discusses how developments in the fields of international responsibility and international criminal law have implications for building a framework for the human rights obligations of non-state actors in international law. In turn these international developments have drawn on the changing ways in which human rights are implemented in national law. A selection of national jurisdictions, including the United States, South Africa and the United Kingdom are examined with regard to the application of human rights law to non-state actors.   The book's final part includes suggestions with regard to understanding the parameters of the human rights obligations of non-state actors. Key to understanding the legal obligations of non-state actors are concepts such as dignity and democracy. While neither concept can unravel the dilemmas involved in the application of human rights law to non-state actors, a better understanding of the tensions surrounding these concepts can help us to understand what is at stake.","brand":"WoB","offers":[{"title":"US \/ GOOD \/ SBYB","offer_id":50345678799121,"sku":"CIN0199288461G","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/0199288461.jpg?v=1750940396"},{"product_id":"peoples-rights-book-philip-alston-9780199243655","title":"Peoples' Rights","description":"The right to self-determination has been a driving force in international law and politics through much of the post World War II period. It also situates these theoretical debates within the context of the political landscape of European contract law and the divergent views expressed by lawmakers, legal academics, and other stakeholders.   This work moves beyond the acquis positivism, market reductionism, and private law essentialism that tend to dominate these conversations and foregrounds normative complexity. It explores the principles and values behind various arguments used in the debates on European contract law and its future to highlight the normative stakes involved in the practical question of what we, as a society, should do about contract law in Europe. In so doing, it opens up democratic space for the consideration of alternative futures for contract law in the European Union, and for better justifications for those parts of the EU contract law acquis we wish to retain.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":50999795384593,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":50999798333713,"sku":"NIN9780192843654","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/0192843656.jpg?v=1751227052"},{"product_id":"global-rights-book-nehal-bhuta-9780198940166","title":"Global Rights?","description":"What is the place of human rights law within global governance? How can we safeguard human rights in various sites of global governance? What is the role of the state, non-state actors, and global governance institutions in all this? Global Rights?: Human Rights in Complex Governance interrogates how human rights and global governance interact with various sub-fields of international and transnational regulation to answer these foundational questions.  The volume offers a detailed exploration of the role of human rights in global governance contexts, such as the sovereign debt regime, global value chains, development assistance, international food governance, and the laws of war. Through an in-depth study of several global governance regimes based on diverse theoretical and methodological approaches, this volume challenges the mainstream discourse on the evolution of human rights law and its limits. As a result, issue areas that are rarely in conversation with each other--such as the World Bank's practices and the law on the use of force--are examined through a common analytical framework that is both rich and flexible enough to shed new light on individual areas of concern and simultaneously reflect on cross-cutting themes.  Bringing human rights experts together with leading scholars in the law of international organizations, public finance, corporations, and use of force, Global Rights? thus serves as a contemporary reflection and set of arguments on how to study and productively think about human rights in complex governance settings.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51000081187089,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":51000085020945,"sku":"NIN9780198940166","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/0198940165.jpg?v=1750694458"},{"product_id":"emergence-of-european-society-through-public-law-book-armin-von-bogdandy-9780198909347","title":"The Emergence of European Society through Public Law","description":"Many Europeans struggle to understand where EU-centred Europeanization has led them. The standard response - that their situation is sui generis, one of a kind - no longer holds. Brexit, conflicts over European financial transfers, immigration, or dubious judicial reforms in some Member States demand a more substantial answer.   Against that background, The Emergence of European Society Through Public Law: A Hegelian and Anti-Schmittian Approach frames European integration by reconstructing European public law in light of Article 2 of the Treaty on European Union (TEU). According to Article 2, all Europeans today are part of one society. European integration may not have produced a European federal state, but it has helped create a European society. This society is intimately interwoven with European public law, as the Treaty characterizes it with 12 constitutional principles. The book interprets this statement as the manifesto, identity, and constitutional core of a democratic society. Thus, Europeans should understand that European integration has ushered in a European democratic society.   Comprehensive and engaging, The Emergence of European Society Through Public Law examines the great debates of European public law and presents them in a new and forward-looking reconstruction. This new narrative of European legal integration will appeal to academics and students of EU law, constitutional and comparative law, sociology, political science, and legal history. Human Rights in Transition combines rich theoretical reflections with practice-informed observations about human rights and their potential futures. The book eschews the polarized and one-sided approach which can too easily dominate either side of the debate. Instead, drawing on deep learning and a range of engagements with human rights institutions, the authors develop a prognosis for contours of human rights law and politics, and its impacts, in the current conjuncture.   The book charts new ways to consider human rights in the concrete areas of specific rights such as social and economic rights, institutional settings (the EU and the UN treaty bodies), and agendas, namely feminism and climate change. The results are a very rich set of essays which delve deeply into specific topics in human rights law and practice, and work outwards from a rigorous analysis of the past and present, to an argument about how to think about the future.  Sensitive and thought-provoking, this book will fast become a defining volume on questions about the role of human rights in the past, present, and future and will remain valuable to anyone interested in understanding, diagnosing, and ultimately acting to help bring about, the possible futures of human rights.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51000135287057,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":51000138727697,"sku":"NIN9780198901921","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/0198901925.jpg?v=1750940180"},{"product_id":"developments-in-eu-external-relations-law-book-marise-cremona-9780199552894","title":"Developments in EU External Relations Law","description":"External relations is currently among the most dynamic areas of EU law, its institutional structures profoundly affected by the Lisbon Treaty. This volume gathers leading analysts to assess core recent developments in the field, taking stock of the current law and potential developments in major policy areas.   The volume opens with an assessment of a central concept at the heart of EU external relations, underpinning its international identity. Christophe Hillion analyses the legal principles which ensure coherence between different strands of the EU's external activity, and the contribution of law to the consistency of the EU's international presence. Frank Hoffmeister turns the focus outwards to the interaction between the EU and the international legal order - the legal basis for the EU's activity in shaping international law and the EU's contribution to 'state practice'.   These opening chapters develop a picture of the EU's active international participation as well as the characteristic structural complexity of its external relations, and against this background the remainder of the book examines key policy areas of EU external action. Lorand Bartels analyses the relationship between trade policy and development; Markus Krajewski discusses trade in services and the link between external and internal policy issues; and Nathalie Tocci assesses the EU's contribution to conflict resolution, an important focus of the Common Foreign and Security Policy. The complex policy picture that emerges from the different goals, values and instruments across these areas is examined in the book's final chapter which focuses on the European Neighbourhood Policy, frequently proclaimed as a strategic priority for the EU.   Together, the essays present a clear picture of the complex development of EU external relations, of the struggle for coherence in the increasingly active, visible and self-conscious role played by the EU as a participant in the international legal order.","brand":"WoB","offers":[{"title":"US \/ NEW \/ INGRAM","offer_id":51000174936337,"sku":"NIN9780199552894","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52147674644753,"sku":"NLS9780199552894","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/0199552894.jpg?v=1750779848"},{"product_id":"cultural-dimension-of-human-rights-book-ana-filipa-vrdoljak-9780199642120","title":"The Cultural Dimension of Human Rights","description":"The intersections between culture and human rights have engaged some of the most heated and controversial debates across international law and theory. As understandings of culture have evolved in recent decades to encompass culture as ways of life, there has been a shift in emphasis from national cultures to cultural diversity within and across states. This has entailed a push to more fully articulate cultural rights within human rights law.  This volume analyses a range of responses by international law, and particularly human rights law, to some of the thorniest, perennial, and sometimes violent confrontations fuelled by culture in relations between individuals, groups and the state in international society. Across the different issues tackled, the contributions are tied by one unifying thread - that culture is understood, protected and promoted not only for its physical manifestations. Rather, it is the relationship of culture to people, individually or in groups, and the diversity of these relationships which is being protected and promoted; hence, the fundamental overlap between culture and human rights.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51000223662353,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":51000226545937,"sku":"NIN9780199642120","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52410618544401,"sku":"NLS9780199642120","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/0199642125.jpg?v=1751356181"},{"product_id":"fundamentals-of-eu-law-revisited-book-catherine-barnard-9780199226221","title":"The Fundamentals of EU Law Revisited","description":"With the rejection of the Constitutional Treaty in French and Dutch referenda, the European Union received a severe blow. Does the Treaty's rejection signal the failure of the Union's goal of democratic governance?   The essays in this volume examine the impact of the debate surrounding the future of the European Constitution on the development of core areas of EU law and policy. On this basis it explores the emergence of a nascent Common Law of International Trade.   This exploration is rooted in three phenomena:   Firstly, the fact that the very same regulatory measure may come simultaneously within the jurisdictional reach of more than one trade regime and may even be adjudicated simultaneously. Some regimes offer alternatives. The NAFTA, for example, offers GATT dispute resolution as an option for many of its own disputes.   Secondly, convergence in the material law of the disparate international trade regimes. This, of course, is the heart of the emergent Common Law.   Thirdly, the strengthening of private parties in all regimes. Once a preserve of the EU, the NAFTA allows private party dispute resolution of different types in relation to various matters and in the case of the WTO, although it is still an intergovernmental preserve, private actors are learning to manipulate the system.   This volume, built on a recent series of courses at the Academy of European Law, is a reflection of this conviction. The various contributions deal with discrete areas in the double sense of the international trading system but each placing considerable emphasis on the interlocking nature of the various components of that system. It is our conviction that this is the appropriate way to understand and to teach this branch of the law.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51249402642705,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":51249404477713,"sku":"NIN9780198298748","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52403613335825,"sku":"NLS9780198298748","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/0198298749.jpg?v=1751355986"},{"product_id":"frontiers-of-human-rights-book-nehal-bhuta-9780198769279","title":"The Frontiers of Human Rights","description":"In an epoch of transnational armed conflict, global environmental harm, and rising inequality, the extraterritorial application of human rights law has become a pressing and controversial legal issue. The concept of the AFSJ was introduced into the EU Treaty framework by the Treaty of Amsterdam in 1997, and it incorporates migration law, family reunion law, asylum law, police cooperation, and cooperation in criminal law. Each of these areas of law is the subject of an in-depth examination in a separate chapter of this book.  The early years of the AFSJ, building upon a substantial body of law already in place under the Treaty of Maastricht and various intergovernmental arrangements, have witnessed a rapid expansion in legislative and executive activity in the field of European internal security. In migration law, family reunion law, asylum law, police co-operation, and co-operation in criminal law, the scale and intensity of action at the supranational level is already such as to overturn longstanding assumptions about the priority of national law in matters of migration control and criminal justice.   An introductory chapter examines the various policy strands covered by the AFSJ; investigates what, if anything, can be viewed as its distinctive legal underpinning; and discusses its possible future development in the light of current discussions over the adoption of a first documentary Constitution for the European Union. In addition to setting out the main contours of legal policy, each chapter examines the continuing tension between national sovereignty on the one hand and a growing commitment to collective, EU-wide action on the other. The volume also addresses the wider constitutional implications of a growing supranational capacity in questions of the priority of political values in the evolving EU; fundamental rights protection; the control of new forms of executive and administrative discretion; and the pressures of accommodating the ten new Enlargement states within the internal security field.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51288422220049,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":51288423923985,"sku":"NIN9780199274642","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ INGRAM","offer_id":52332479643921,"sku":"NLS9780199274642","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/0199274649.jpg?v=1751227198"},{"product_id":"europe-s-area-of-freedom-security-and-justice-book-neil-walker-9780199274659","title":"Europe's Area of Freedom, Security, and Justice","description":"Exploring the main areas of legal development under the so-called \"Area of Freedom, Security, and Justice\" (AFSJ), this title examines the main subject matter of the new AFSJ: migration, family reunion, asylum, police co-operation, and cooperation in matters of criminal law and procedure.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51288423104785,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":51288425333009,"sku":"NIN9780199274659","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52136786690321,"sku":"NLS9780199274659","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/0199274657.jpg?v=1750738025"},{"product_id":"human-rights-obligations-of-non-state-actors-book-andrew-clapham-9780198298151","title":"Human Rights Obligations of Non-State Actors","description":"The threats to human rights posed by non-state actors are of increasing concern. Human rights activists increasingly address the activity of multinational corporations, the policies of international organizations such as the World Bank and the World trade Organisation, and international crimes committed by entities such as armed opposition groups and terrorists. This book presents an approach to human rights that goes beyond the traditional focus on states and outlines the human rights obligations of non-state actors. Furthermore, it addresses some of the ways in which these entities can be held legally accountable for their actions in various jurisdictions.  The political debate concerning the appropriateness of expanding human rights scrutiny to non-state actors is discussed and dissected. For some, extending human rights into these spheres trivializes human rights and allows abusive governments to distract us from ongoing violations. For others such an extension is essential if human rights are properly to address the current concerns of women and workers. The main focus of the book, however, is on the legal obligations of non-state actors. The book discusses how developments in the fields of international responsibility and international criminal law have implications for building a framework for the human rights obligations of non-state actors in international law. In turn these international developments have drawn on the changing ways in which human rights are implemented in national law. A selection of national jurisdictions, including the United States, South Africa and the United Kingdom are examined with regard to the application of human rights law to non-state actors.   The book's final part includes suggestions with regard to understanding the parameters of the human rights obligations of non-state actors. Key to understanding the legal obligations of non-state actors are concepts such as dignity and democracy. While neither concept can unravel the dilemmas involved in the application of human rights law to non-state actors, a better understanding of the tensions surrounding these concepts can help us to understand what is at stake.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51548347531537,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ VERY_GOOD \/ INTERNAL","offer_id":51548347826449,"sku":"GOR007653405","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52121248465169,"sku":"NLS9780198298151","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/0198298153.jpg?v=1751443986"},{"product_id":"legitimacy-of-eu-environmental-governance-and-the-role-of-the-european-courts-book-emma-lees-9780198972808","title":"The Legitimacy of EU Environmental Governance and the Role of the European Courts","description":"European courts have an important role to play in contributing to the legitimacy of EU environmental governance. Their role in holding to account and scrutinizing administrative and legislative acts is critical to the overall legitimacy of the political system. However, the boundaries of legitimacy in governance are themselves being shaped by the environmental context. This volume explores how the environment affects the ways in which the courts can support the legitimacy of EU governance, and, in turn, what the courts themselves bring to the table in enhancing that legitimacy.  The Legitimacy of EU Environmental Governance and the Role of the European Courts considers soft law, human rights, the environmental principles, judicial procedures and remedies, and the wider European law context, to examine the dynamics which shape the courts' contributions to legitimacy.   Bringing together leading authors in EU constitutional and administrative law and EU environmental law, this book explores the ways in which environmental degradation is shifting how the courts, and we, assess what legitimate governance actually consists of.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51595259248913,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ GARDNERS","offer_id":51595261051153,"sku":"NGR9780198972808","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"US \/ NEW \/ INGRAM","offer_id":52495845818641,"sku":"NIN9780198972808","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/0198972806.jpg?v=1751227022"},{"product_id":"discrimination-and-human-rights-book-sandra-fredman-fba-9780199246038","title":"Discrimination and Human Rights","description":"This set of essays provides and important contribution to the debate about the role of human rights law in combating racism. However, until recently, the field has largely overlooked some of the most enduring and pervasive injustices of human history: racism and the colonialism and slave-trade that both reflected and fuelled it. Race and Transitional Justice examines how race and racism interact with transitional justice mechanisms and institutions to question why this is the case, and how it could be different.   Bringing together diverse perspectives to examine the historical and socio-political contexts of transitional justice, this book argues that the field remains largely inattentive to the role of race. As a result, transitional justice institutions may be sustaining the very racialization that they are expected to remedy. The contributions offer a range of responses. Some call to abandon the whole field, citing its complicity in the indefinite maintenance of settler hegemony. Others consider transitional justice an essential space to work towards a more just, non-racist, social order. The result is a sensitive reflection into emancipatory transitional justice futures.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ GARDNERS","offer_id":52100680450321,"sku":"NGR9780198992660","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"US \/ NEW \/ INGRAM","offer_id":53059741745425,"sku":"NIN9780198992660","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9780198992660.jpg?v=1772035460"},{"product_id":"access-to-justice-as-a-human-right-book-francesco-francioni-9780199233090","title":"Access to Justice as a Human Right","description":"In international law, as in any other legal system, respect and protection of human rights can be guaranteed only by the availability of effective judicial remedies. When a right is violated or damage is caused, access to justice is of fundamental importance for the injured individual and it is an essential component of the rule of law. Yet, access to justice as a human right remains problematic in international law. First, because individual access to international justice remains exceptional and based on specific treaty arrangements, rather than on general principles of international law; second, because even when such right is guaranteed as a matter of treaty obligation, other norms or doctrines of international law may effectively impede its exercise, as in the case of sovereign immunity or non reviewability of UN Security Council measures directly affecting individuals. Further, even access to domestic legal remedies is suffering because of the constraints put by security threats, such as terrorism, on the full protection of freedom and human rights.  This collection of essays offers seven distinct perspectives on the present status of access to justice: its development in customary international law, the stress put on it in times of emergency, its problematic exercise in the case of violations of the law of war, its application to torture victims, its development in the case law of the UN Human Rights Committee and of the European Court of Human Rights, its application to the emerging field of environmental justice, and finally access to justice as part of fundamental rights in European law.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52123686011153,"sku":"NLS9780199233090","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ VERY_GOOD \/ INTERNAL","offer_id":53058552758545,"sku":"GOR007936214","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9780199233090.jpg?v=1757452137"},{"product_id":"accountability-in-the-european-union-book-carol-harlow-9780199245932","title":"Accountability in the European Union","description":"The debate over the 'democratic deficit' of the European Union has tended to focus on the legitimacy and representativeness of the European Parliament. It has been the policy-making powers of the Parliament and its struggle to secure the dominant role in law-making which have attracted attention. The dramatic resignation of the Santer Commission early in 1999, following a critical report to the Parliament, highlighted the growing problem of accountability in the European Union and echoed concerns regularly expressed by the European Council during inter-governmental conferences for the efficiency and effectiveness of the Union and its institutions. The resignations were followed by the appointment of President Romano Prodi with a mandate for reform of the Commission.  The present book approaches the issue of democratic deficit from the angle of accountability, today seen as an essential element of democratic government. It looks at differing understandings of the concept in the Member States and at various techniques, political, legal, and managerial, by which accountability can be ensured. These include the Parliament as well as national parliaments but extend to less familiar institutions, such as the European Court of Auditors. The book caters for a general readership and is intended for all those who are interested in the governance of the European Union.  The author draws the conclusion that in trans-national forms of governance such as the European Union, it is difficult to hold policy-makers to account. Some of the reasons are institutional, others political and social. Without a vibrant civil society, the very notion of accountability may be a mirage.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52124059926801,"sku":"NLS9780199245932","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":52734559650065,"sku":"NIN9780199245932","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9780199245932.jpg?v=1757455186"},{"product_id":"gender-and-human-rights-book-karen-knop-9780199260911","title":"Gender and Human Rights","description":"The growth of the women's international human rights movement worldwide and its emergence as a field of study has led to a valuable but increasingly self-contained literature, often cut off from developments in feminist legal theory, on the one hand, and conceptions of the different legal contexts in which international human rights operate, on the other. The combination of methodologies used by the EU and the differing levels of enforcement available are characteristic of the EU's compliance system, permitting the remarkable reach and penetration of EU norms into national systems. In this new study six authors offer their 1ssessment of the enforcement procedures and compliance processes that have been developed to ensure Member State compliance with EU law. The first three chapters examine the merits of combining both coercive and problem-solving strategies, describing the systems in place and focussing on the different levels at which compliance mechanisms operate: national, regional, and international. It also looks at horizontal compliance as well as 'from above' compliance, creating a complex and rich picture of the EU's system.  The final three chapters of the book focus on different aspects of compliance seen from a national perspective. The first analyses the two bases for the use of criminal sanctions to enforce EU law: the ability of Member States to choose to include criminal penalties for non-compliance in their national law; and the imposition of criminal sanctions at a national level by EU law itself. The book then moves on to a discussion of the role of national courts in ensuring Member State compliance with, and enforcement of, EU law. It examines the role of national constitutional courts in facilitating compliance with EU law and draws comparisons between EU law and international law and their interactions both with each other and with national constitutional courts.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52133928501521,"sku":"NLS9780199644735","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9780199644735.jpg?v=1757537672"},{"product_id":"fundamentals-of-eu-law-revisited-book-catherine-barnard-9780199226214","title":"The Fundamentals of EU Law Revisited","description":"With the rejection of the Constitutional Treaty in French and Dutch referenda, the European Union received a severe blow. If the UN is put in charge of a territory, is it bound by human rights law? Does that body of law apply to private security contractors who use torture to achieve their goals? Does the right to freedom of speech apply in a private shopping mall which has become the modern-day town centre?   Under traditional approaches to human rights, non-State actors are beyond the direct reach of international human rights law. They cannot be parties to the relevant treaties and so they are only bound to the extent that obligations accepted by States can be applied to them by governments. The result is that entities including Non-Governmental Organizations, international organizations such as the UN and the IMF, private security contractors, and transnational corporations, along with many others, are generally considered not to be bound directly by human rights law.  This situation threatens to make a mockery of much of the international system of accountability for human rights violations. As privatization, outsourcing, and downsizing place ever more public or governmental functions into the hands of private actors, the human rights regime must adapt if it is to maintain its relevance. The contributors to this volume examine the different approaches that might be taken in order to ensure some degree of accountability. This book aims to bring the EU's executive powers out of the shadows by mapping the evolution and current form of the EU's various executive actors, their powers, and the mechanisms for holding them accountable. In doing so it provides a rich understanding of the way in which the EU's institutional and legal framework fits within national constitutional presumptions about how power should be controlled and accountability achieved.  Covering both the political executive and the administrative executive at the EU institutional level, the book analyses their relationship with national executive power, and traces the historical evolution of executive order in Europe from the Peace of Westphalia through classic inter-governmental organizations to the allegedly unique EU framework. The book's analysis covers both the formal legal structure of the Union and the evolution of the EU's living institutions in practice. Focusing on recent developments in respect to institutions such as the UN Human Rights Council and the EU's Fundamental Rights Agency (FRA), these essays present a thorough account of the objectives and challengers facing the international community today with respect to human rights. It amounts, lato sensu, to the right to the realization of justice.   In such understanding, it comprises not only the formal access to a tribunal or judge, but also respect for the guarantees of due process of law, the right to a fair trial, and to reparations (whenever they are due), and the faithful execution of judgments. On its part, the right to an effective domestic remedy is a basic pillar of the rule of law in a democratic society. In its part, the right of international individual petition, together with the safeguard of the integrity of international jurisdiction, constitute the basic foundations of the emancipation of the individual vis-à-vis his own State.   This is a domain that has undergone a remarkable development in recent years. It is submitted that the right of access to justice belongs today to the domain of jus cogens. Without it, there is no legal system at all. The protection of the human person in the most adverse circumstances has evolved amongst considerations of ordre public. Such recent evolution has been contributing to the gradual expansion of the material content of jus cogens.  Furthermore, the very notion of \"victim\" (encompassing direct, indirect and potential victims) has been the subject of a considerable international case-law. Victims have had their cause vindicated in situations of utmost adversity, if not defencelessness (e.g., abandoned or \"street children\", undocumented migrants, members of peace communities in situations of armed conflict, internally displaced persons, individuals in infra-human conditions of detention, surviving victims of massacres).","brand":"WoB","offers":[{"title":"- \/ - \/ INTERNAL","offer_id":52323511042321,"sku":null,"price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ GARDNERS","offer_id":52323511599377,"sku":"NGR9780199580958","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9780199580958.jpg?v=1757977310"},{"product_id":"human-rights-book-christian-tomuschat-9780199683734","title":"Human Rights","description":"This third edition of Human Rights: Between Idealism and Realism presents human rights in action, focusing on their effectiveness as legal tools designed to benefit human beings. By combining conceptual analysis with an emphasis on procedures and mechanisms of implementation, this volume provides a multidimensional overview of human rights. After examining briefly the history of human rights, the author analyses the intellectual framework that forms the basis of their legitimacy. In particular, he covers the concept of universality and the widely used model that classifies human rights into clusters of different 'generations'.   In this edition, the author brings together the fundamental aspects of human rights law, addressing human dignity as the ethical foundation of human rights, the principle of equality and non-discrimination as the essence of any culture of human rights, the protections against racial discrimination and discrimination against women, and assesses the individual as a subject of international law. The volume then moves on to assess the activities of the political institutions of the United Nations, the expert bodies established by the relevant treaties, and the international tribunals specifically entrusted at the regional level with protecting human rights. This edition also includes specific analysis of the actions mandated by the UN Security Council against Libya in 2011. It also includes greater coverage of the jurisprudence of the Inter-American Court of Human Rights and the African Commission on Human and Peoples' Rights. The author explains how and why the classical array of politically inspired informal devices has been enriched by the addition of international criminal procedures and by endeavours to introduce civil suits against alleged individual violators of human rights. Finally, the volume is rounded off by a consideration of the importance of humanitarian law as an instrument for the protection of human life and dignity and an exploration of the future of human rights.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ GARDNERS","offer_id":52323518185745,"sku":"NGR9780199683734","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"US \/ VERY_GOOD \/ SBYB","offer_id":52866774270225,"sku":"CIN0199683735VG","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9780199683734.jpg?v=1776939040"},{"product_id":"enlargement-of-the-european-union-book-marise-cremona-9780199260935","title":"The Enlargement of the European Union","description":"This collection of essays reflects on the fifth enlargement of the European Union, projected to take place in 2004. It examines the process of enlargement, its impact on both the candidate States and on the institutions and policies of the European Union. In so doing, it discusses these issues from a variety of perspectives - legal, economic and political - reflecting the different dimensions of the enlargement project. This enlargement will be unlike any other, not only in terms of its scale, and the unprecedented nature of the lengthy and complex pre-accession process, but also in its wider implications for the future direction of the European Union itself and for the whole of Europe. The contributions thus focus not only on the adjustments having to be made by the candidate States and the EU's institutions, but also on enlargement as an interaction between the candidate States and the European Union, and between the EU and the wider world community. Policies which have developed and matured during this enlargement, such as conditionality, also have effects on regions and States which are outside the current enlargement process, such as the Balkans. A greatly enlarged EU has implications also for the EU's trading partners and for its role within the WTO. Different chapters deal with the pre-accession process, the enlargement negotiations, the economic impact of enlargement on the candidate States, membership conditionality as applied by the European Union, the need to adapt the EU's institutional structure to cope with enlargement and the impact of enlargement on the external policies of both the EU and the candidate States.","brand":"WoB","offers":[{"title":"- \/ - \/ INTERNAL","offer_id":52323517825297,"sku":null,"price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ GARDNERS","offer_id":52323518546193,"sku":"NGR9780199260935","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9780199260935.jpg?v=1776938574"},{"product_id":"political-rights-under-stress-in-21st-century-europe-book-wojciech-sadurski-9780199296026","title":"Political Rights Under Stress in 21st Century Europe","description":"Europe has entered the 21st century in a state of growing uncertainty about the role and scope of traditional political rights. The scope of 'political rights' is a subject which has always provoked a degree of scholarly controversy, as indeed is reflected in the essays of this volume. Nonetheless, it has usually been taken as evident that the best cure for various threats to and defects of liberal democracy is more stringent rather than less stringent protection of rights such as freedom of speech, or freedom of political and other forms of association. But the global environment in which Europe finds itself has changed, and has gradually eroded these conventional wisdoms. The increased threat of terrorism on the one hand, epitomised by the events of September 11 2001, and the accession of the post-communist countries of Central and Eastern Europe with their specific political traditions on the other hand, has placed this liberal-democratic consensus under considerable stress.  The essays collected in this volume reflect this stress, and search for answers to the questions raised by the changing political environment. The contributions focus on the European experience but they are placed within a wider global context in reflecting on the appropriate scope and strength of protection of political rights. Under what circumstances is 'militant democracy' - democracy which is intolerant of the enemies of democracy - a cure to the real and imagined threats, and under what circumstances does it become part of the problem? Different chapters deal variously with the theory of political rights, the rights to freedom of expression and to freedom association (focusing particularly on the topical issue of party closures), the understanding of political rights in Central and Eastern Europe and its impact on the democratization of this region, the question of political rights of minorities in this region, and finally the effectiveness of the Council of Europe's monitoring mechanisms.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ GARDNERS","offer_id":52323525296401,"sku":"NGR9780199296026","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9780199296026.jpg?v=1757977343"}],"url":"https:\/\/www.worldofbooks.com\/collections\/collected-courses-of-the-academy-of-european-law-book-series.oembed","provider":"World of Books ","version":"1.0","type":"link"}
