The first part clarifies the requirements on damages claims under both public procurement and general EU law, notably the public procurement remedies directives and doctrines such as procedural autonomy, effective judicial protection and Member State liability. The second part focuses on comparative law, covering England, France, Germany and the Netherlands, and provides an overview of national regulation and case law of damages litigation in the area of public procurement. A third part discusses the constitutive and quantification criteria of the damages remedy from a comparative and EU law perspective. It explores the lost chance, which functionally emerges as a compromise capable of mitigating the typically problematic nature of causation and uncertainty in public procurement constellations. The book concludes with a proposal for legislative intervention regarding damages in public procurement.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51356545876241,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ VERY_GOOD \/ INTERNAL","offer_id":51356545941777,"sku":"GOR014236535","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52487209451793,"sku":"NLS9783319795096","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/3319795090.jpg?v=1751189606"},{"product_id":"cross-border-mergers-book-thomas-papadopoulos-9783030227524","title":"Cross-Border Mergers","description":"This edited volume focuses on specific, crucially important structural measures that foster corporate change, namely cross-border mergers. Such cross-border transactions play a key role in business reality, economic theory and corporate, financial and capital markets law. Since the adoption of the Cross-border Mergers Directive, these mergers have been regulated by specific legal provisions in EU member states. This book analyzes various aspects of the directive, closely examining this harmonized area of EU company law and critically evaluating cross-border mergers as a method of corporate restructuring in order to gain insights into their fundamental mechanisms. It comprehensively discusses the practicalities of EU harmonization of cross-border mergers, linking it to corporate restructuring in general, while also taking the transposition of the directive into account. Exploring specific angles of the Cross-border Mergers Directive in the light of European and national company law, thebook is divided into three sections: the first section focuses on EU and comparative aspects of the Cross-border Mergers Directive, while the second examines the interaction of the directive with other areas of law (capital markets law, competition law, employment law, tax law, civil procedure). Lastly, the third section describes the various member states’ experiences of implementing the Cross-border Mergers Directive.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52121408798993,"sku":"NLS9783030227524","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783030227524.jpg?v=1757430569"},{"product_id":"beyond-networks-interlocutory-coalitions-the-european-and-global-legal-orders-book-gianluca-sgueo-9783319804460","title":"Beyond Networks - Interlocutory Coalitions, the European and Global Legal Orders","description":"This book explores the activism promoted by organised networks of civil society actors in opening up possibilities for more democratic supranational governance. It examines the positive and negative impact that such networks of civil society actors – named “interlocutory coalitions” – may have on the convergence of principles of administrative governance across the European legal system and other supranational legal systems.     The book takes two main controversial aspects into account: the first relates to the convergence between administrative rules pertaining to different supranational regulatory systems. Traditionally, the spread of methods of administrative governance has been depicted primarily against the background of the interactions between the domestic and the supranational arena, both from a top-down and bottom-up perspective. However, the exploration of interactions occurring at the supranational level between legal regimes is still not grounded on adequate empirical evidence. The second controversial aspect considered in this book consists of the role of civil society actors operating at the supranational level. In its discussion of the first aspect, the book focuses on the relations between the European administrative law and the administrative principles of law pertaining to other supranational regulatory regimes and regulators, including the World Bank, the International Monetary Fund, the World Trade Organization, the United Nations, the Organization for Economic Cooperation and Development, the Asian Development Bank, and the Council of Europe. The examination of the second aspect involves the exploration of the still little examined, but crucial, role of civil society organised networks in shaping global administrative law. These “interlocutory coalitions” include NGOs, think tanks, foundations, universities, and occasionally activists with no formal connections to civil society organisations. The book describes such interlocutory coalitions as drivers of harmonized principles of participatory democracy at the European and global levels. However, interlocutory coalitions show a number of tensions (e.g. the governability of coalitions, the competition among them) that may hamper the impact they have on the reconfiguration of individuals’ rights, entitlements and responsibilities in the global arena.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52121672188177,"sku":"NLS9783319804460","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319804460.jpg?v=1757433464"},{"product_id":"rethinking-investor-state-arbitration-book-flavia-marisi-9783031381836","title":"Rethinking Investor-State Arbitration","description":"A significant increase in investor-State arbitration cases has been observed since the 2000s. The trust placed by investors and States in this method of dispute resolution stems from several strengths. In addition to its neutrality, one of the primary reasons for its widespread use is its adaptability, enabling it to address specific challenges that have emerged in recent decades. The following elements highlight this adaptability: the arbitration procedure can be customised to meet the specific needs of the disputing parties and stakeholders involved. It effectively responds to evolving cultural norms and ethical considerations, such as diversity, gender representation, corporate social responsibility, environmental issues, and human rights. Moreover, it can adapt to global health crises by facilitating online hearings. Finally, during times of international armed conflict, economic exchanges, trade, investment, and investor-State dispute settlement foster economic integration and interdependence, contributing to maintaining commercial peace and supporting international peace and security. However, investor-State arbitration has sparked vigorous debates, with many advocating for reform in three crucial aspects: transparency, legitimacy, and consistency. Multilateral negotiations are currently underway on various fronts, including the negotiation of more sustainable investment treaties, amendments to institutional arbitral rules, the design of a multilateral investment court, and the development of enhanced policy frameworks. This book delves into the history of investor-State dispute resolution to provide readers with an understanding of how its main features have evolved over time. It examines the most intensely debated procedural issues, analyses their multifaceted characteristics, reviews the complex relationship between investor-State arbitration and the European Union, and explores potential options for addressing stakeholder concerns.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52127205228817,"sku":"NLS9783031381836","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783031381836.jpg?v=1757484465"},{"product_id":"varieties-of-european-economic-law-and-regulation-book-kai-purnhagen-9783319049021","title":"Varieties of European Economic Law and Regulation","description":"This is the first book to comprehensively analyze the work of Hans Micklitz, one of the leading scholars in the field of EU economic law. This book compares the European Union (EU) as the most successful union, which was able to move from the common financial market to the top of banking integration - the Banking Union, and the Eurasian Economic Union (EAEU) as a relatively young union but having many good prerequisites to become an influential union, established by five states - the Russian Federation, Kazakhstan, Belarus, Armenia, and the Kyrgyz Republic in 2015. The key research question is whether the single market in banking services or banking union is a reachable goal or on the contrary- utopia. Throughout the research, the book uncovers the bottlenecks and barriers that the EU and EAEU policymakers faced during the difficult process of establishing the single market and baking union. However, along with the problems of banking integration, the book identifies many particularities of the harmonization of banking legislations of the EU Member States. These identified particularities can be very beneficial for young unions and serve as a kind of guide in their integration processes. In particular, the book comes to the findings that evolutionary (not revolutionary) harmonization is required in order for the EAEU to become a full-fledged union. The full-fledged union, which was mutually established by the EAEU Member States with the purpose of bringing positive results for all its Member States, but not just as a counterbalance to the EU.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52131819716881,"sku":"NLS9783031152849","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783031152849.jpg?v=1757512768"},{"product_id":"e-food-closing-the-online-enforcement-gap-in-the-eu-platform-economy-book-maria-jose-plana-casado-9783030795061","title":"E-FOOD: Closing the Online Enforcement Gap in the EU Platform Economy","description":"In fact, sector-specific legislation, including Food Law, largely ignores online transactions. While to date the objective has been achieved through fiscal and macroeconomic consolidation in the member states and the activation of stabilisation mechanisms in cases of emergency, the book argues that full stability requires a better system of economic governance, either through a process of partial fiscal centralisation or the return to a more efficient and sustainable market discipline of public finances. Despite being the backbone of the EU agricultural system, SFSCs’ position in the current socioeconomic narrative has not been sufficiently fostered. In response, the book traces how SFSCs have historically been dealt with under the agricultural rules of the CAP, and to a much lesser extent, those relating to internal market food law, delving into the intricate relationship between agricultural and food law.    The integration of these two disciplines into an agri-food law domain represented a pivotal shift in legal discourse, in particular in the context of SFSC regulation. The legal analysis extends its scope to encompass spatial and historical dimensions, enriching the contextual understanding of regulatory frameworks over time and across geographical boundaries.    This new conceptualisation does not aim to establish a universal, ‘set-in-the-stone’ legal definition for SFSC applicable across disciplines. Rather, it seeks to identify common themes and key features among various SFSC initiatives. These themes serve as the foundation for determining a set of minimum legal requirements for the recognition and valorisation of SFSC initiatives at the EU level, which Member States can then tailor to their specific needs. The goal is to lay the groundwork for developing a concept that can be effectively operationalised across different sectors and geographical dimensions.    The book makes a substantial contribution to the current academic debate, filling a significant gap in the existing CAP literature. On the one hand, it provides the first comprehensive and systematic analysis of all the measures that have addressed small farmers and SFSCs, from the CAP reforms up to the present day. On the other, by adopting a new multidisciplinary perspective encompassing legal, sociological, and agri-food studies, it raises new questions on the role of short supply chains in light of the Farm to Fork Strategy and beyond.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ GARDNERS","offer_id":52153278136593,"sku":"NGR9783031693892","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783031693892.jpg?v=1757619575"},{"product_id":"institutionalisation-beyond-the-nation-state-book-elaine-fahey-9783319502205","title":"Institutionalisation beyond the Nation State","description":"This volume collects papers that explore institutionalisation in contemporary transatlantic relations. Consequently, the national application of these provisions has become increasingly more common across the European Union. This national application poses various challenges for those concerned about the consistent application of EU competition law.   This edited collection provides an in-depth analysis of the most important limitations of, and the challenges concerning, the applicability of Articles 101 and 102 TFEU at national level. Divided into five parts, the book starts out by examining how the consistent enforcement of Articles 101 and 102 TFEU operates as a general EU competition policy. It then discusses several recent landmark cases of the European Court of Justiceon Articles 101 and 102 TFEU, before proceeding to analyse certain additional, unique jurisdictional challenges to the uniform application of the EU competition law provisions. Subsequently, it focuses on one of the most important instruments that can help to achieve the uniform application of EU competition law in cases handled by the national courts: preliminary rulings. Finally, it provides selective examples of how Articles 101 and 102 TFEU are effectively applied at national level, thereby providing additional input into how problematic the issue of consistent application of EU competition law is in practice.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52407727849745,"sku":"NLS9783319473819","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319473819.jpg?v=1758772898"},{"product_id":"pursuit-of-stability-of-the-euro-area-as-a-whole-book-luca-lionello-9783030280444","title":"The Pursuit of Stability of the Euro Area as a Whole","description":"This book analyses the ongoing reform of the European economic union in the light of the new objective of 'stability of the euro area as a whole' in Article 136(3) TFEU. Under the macroprudential mandate, the regulator monitors and judiciously controls systemic risk in the financial system, in an attempt to minimise the probability and severity of a future financial crisis. The book reveals why MPP authorities are rightfully at the centre of a highly sensitive policy debate, as MPP necessitates the allocation of significant regulatory power to technocrats, while the highly technical nature of MPP makes policy evaluation challenging. Specific issues examined include: the importance of financial stability as a public policy goal; the political economy issues stemming from the delegation of MPP to an independent authority; and the definition of accountability in the context of MPP. Focusing on a case study on the Financial Policy Committee of the Bank of England, the macroprudential authority in the UK, the book develops the normative grounds to justify the need for accountability in the conduct of MPP, while also formulating the necessary institutional framework to ensure the accountability of MPP authorities.","brand":"WoB","offers":[{"title":"- \/ - \/ INTERNAL","offer_id":52418601189649,"sku":null,"price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ GARDNERS","offer_id":52418601910545,"sku":"NGR9783031335785","price":0.0,"currency_code":"GBP","in_stock":false}]},{"product_id":"eu-investor-protection-regulation-and-liability-for-investment-losses-book-marnix-wallinga-9783030540005","title":"EU Investor Protection Regulation and Liability for Investment Losses","description":"This book examines the relationship between the EU investor protection regulations enshrined in MiFID and MiFID II and national contract and torts law. It describes how the effect of the conduct of business rules as implemented in national financial supervision legislation in private law extends to the issue of enforcement, and critically assesses this interaction from the perspective of EU law. In particular, the conclusions identified in the book will deepen readers’ understanding of the interplay between the conduct of business rules and private law norms governing a firm’s liability to pay damages, such as duty of care, attributability of damage, causation, contributory negligence and limitation. In turn, the book identifies the subordination and the complementarity model to conceptualise the interaction between the conduct of business rules and private law norms.    Moreover, the book challenges the view that civil courts are – or should be – forced to give privatelaw effects to violation of the MiFID and MiFID II conduct of business rules in line with the subordination model. Instead, the complementarity model is advanced as the preferred approach to this interaction in view of what MiFID and MiFID II require from Member States in terms of their implementation, as well as the desirability of each model. This model presupposes that courts should consider the conduct of business rules when adjudicating individual disputes, while preserving the autonomy of private law norms governing liability of investment firms towards clients.    Based on analysis of case law of courts in Germany, the Netherlands and England \u0026amp; Wales, as well as scholarly literature, the book also compares the available causes of action, the conditions of liability and the obstacles investors face when claiming damages, as well as how and the extent to which investors can benefit from the conduct of business rules in clearing these obstacles. This book compares the European Union (EU) as the most successful union, which was able to move from the common financial market to the top of banking integration - the Banking Union, and the Eurasian Economic Union (EAEU) as a relatively young union but having many good prerequisites to become an influential union, established by five states - the Russian Federation, Kazakhstan, Belarus, Armenia, and the Kyrgyz Republic in 2015. The key research question is whether the single market in banking services or banking union is a reachable goal or on the contrary- utopia. Throughout the research, the book uncovers the bottlenecks and barriers that the EU and EAEU policymakers faced during the difficult process of establishing the single market and baking union. However, along with the problems of banking integration, the book identifies many particularities of the harmonization of banking legislations of the EU Member States. These identified particularities can be very beneficial for young unions and serve as a kind of guide in their integration processes. In particular, the book comes to the findings that evolutionary (not revolutionary) harmonization is required in order for the EAEU to become a full-fledged union. The full-fledged union, which was mutually established by the EAEU Member States with the purpose of bringing positive results for all its Member States, but not just as a counterbalance to the EU.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52481980956945,"sku":"NLS9783031152818","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783031152818.jpg?v=1759852528"},{"product_id":"impact-of-wto-sps-law-on-eu-food-regulations-book-chris-downes-9783319043722","title":"The Impact of WTO SPS Law on EU Food Regulations","description":"This book brings a fresh perspective on the emerging field of international food law with the first detailed analysis of the process and implications of domestic compliance with the World Trade Organisation (WTO) Sanitary and Phytosanitary (SPS) Agreement. It investigates the influence of WTO disciplines on the domestic policy-making process and examines the extent to which international trade law determines European Union (EU) food regulations.  Following controversial WTO rulings on genetically-modified foods and growth hormones in beef, awareness and criticism of global rules governing food has grown considerably. Yet the real impact of this international legal meta-framework on domestic regulations has remained obscure to practitioners and largely unexplored by legal commentators. This book examines the emergence of transnational governance practices set in motion by the SPS Agreement and their role in facilitating agricultural trade. In so doing, it complements and challenges conventional accounts of the SPS regime dominated by analysis of WTO disputes.  It reviews legal commentary of the SPS Agreement to understand why WTO rules are so commonly characterised as a significant threat to domestic food policy preferences. It then takes on these assumptions through an in-depth review of food policies and decision-making practices in the EU, revealing both the potential and limits of WTO law to shape EU policies. It finally examines two important venues for the generation of global food norms – the WTO SPS Committee and Codex Alimentarius – to evaluate the practice and significance of transnational governance in this domain. Through detailed case studies including novel foods, food additives, vitamin and mineral supplements and transparency and equivalence procedures, this book provides a richer account of compliance and exposes the subtle, but important influence of WTO obligations.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ GARDNERS","offer_id":52500819443985,"sku":"NGR9783319043722","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":53522911789329,"sku":"NLS9783319043722","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319043722.jpg?v=1760138973"},{"product_id":"contents-and-effects-of-contracts-lessons-to-learn-from-the-common-european-sale-book-aurelia-colombi-ciacchi-9783319802671","title":"Contents and Effects of Contracts-Lessons to Learn From The Common European Sales Law","description":"This book presents a critical analysis of the rules on the contents and effects of contracts included in the proposal for a Common European Sales Law (CESL). The European Commission published this proposal in October 2011 and then withdrew it in December 2014, notwithstanding the support the proposal had received from the European Parliament in February 2014. On 6 May 2015, in its Communication ‘A Digital Single Market Strategy for Europe’, the Commission expressed its intention to “make an amended legislative proposal (…) further harmonising the main rights and obligations of the parties to a sales contract”. The critical comments and suggestions contained in this book, to be understood as lessons to learn from the CESL, intend to help not only the Commission but also other national and supranational actors, both public and private (including courts, lawyers, stakeholders, contract parties, academics and students) in dealing with present and future European and national instrumentsin the field of contract law.    The book is structured into two parts. The first part contains five essays exploring the origin, the ambitions and the possible future role of the CESL and its rules on the contents and effects of contracts. The second part contains specific comments to each of the model rules on the contents and effects of contracts laid down in Chapter 7 CESL (Art. 66-78). Together, the essays and comments in this volume contribute to answering the question of whether and to what extent rules such as those laid down in Art. 66-78 CESL could improve or worsen the position of consumers and businesses in comparison to the correspondent provisions of national contract law. The volume adopts a comparative perspective focusing mainly, but not exclusively, on German and Dutch law.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52532139000081,"sku":"NLS9783319802671","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319802671.jpg?v=1760659593"},{"product_id":"eu-investor-protection-regulation-and-liability-for-investment-losses-book-marnix-wallinga-9783030540036","title":"EU Investor Protection Regulation and Liability for Investment Losses","description":"This book examines the relationship between the EU investor protection regulations enshrined in MiFID and MiFID II and national contract and torts law. It describes how the effect of the conduct of business rules as implemented in national financial supervision legislation in private law extends to the issue of enforcement, and critically assesses this interaction from the perspective of EU law. In particular, the conclusions identified in the book will deepen readers’ understanding of the interplay between the conduct of business rules and private law norms governing a firm’s liability to pay damages, such as duty of care, attributability of damage, causation, contributory negligence and limitation. In turn, the book identifies the subordination and the complementarity model to conceptualise the interaction between the conduct of business rules and private law norms.    Moreover, the book challenges the view that civil courts are – or should be – forced to give privatelaw effects to violation of the MiFID and MiFID II conduct of business rules in line with the subordination model. Instead, the complementarity model is advanced as the preferred approach to this interaction in view of what MiFID and MiFID II require from Member States in terms of their implementation, as well as the desirability of each model. This model presupposes that courts should consider the conduct of business rules when adjudicating individual disputes, while preserving the autonomy of private law norms governing liability of investment firms towards clients.    Based on analysis of case law of courts in Germany, the Netherlands and England \u0026amp; Wales, as well as scholarly literature, the book also compares the available causes of action, the conditions of liability and the obstacles investors face when claiming damages, as well as how and the extent to which investors can benefit from the conduct of business rules in clearing these obstacles. In so doing, under the approachadopted by national courts to the interplay between the conduct of business rules of EU origin and private law, the book shows how investors can benefit from the influence of these rules on private law norms. In closing, it demonstrates a hybridisation of private law remedies resulting from the accommodation of the conduct of business rules into the private law discourse according to the complementarity model, illustrating how judicial enforcement through private law means may contribute to investor protection.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52533052408081,"sku":"NLS9783030540036","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783030540036.jpg?v=1760663398"},{"product_id":"consistent-application-of-eu-competition-law-book-adriana-alman-9783319837253","title":"The Consistent Application of EU Competition Law","description":"In recent years, there has been a decentralisation of the enforcement of the EU competition law provisions, Articles 101 and 102 of the Treaty on the Functioning of the European Union (TFEU). Consequently, the national application of these provisions has become increasingly more common across the European Union. This national application poses various challenges for those concerned about the consistent application of EU competition law.   This edited collection provides an in-depth analysis of the most important limitations of, and the challenges concerning, the applicability of Articles 101 and 102 TFEU at national level. Divided into five parts, the book starts out by examining how the consistent enforcement of Articles 101 and 102 TFEU operates as a general EU competition policy. It then discusses several recent landmark cases of the European Court of Justiceon Articles 101 and 102 TFEU, before proceeding to analyse certain additional, unique jurisdictional challenges to the uniform application of the EU competition law provisions. Subsequently, it focuses on one of the most important instruments that can help to achieve the uniform application of EU competition law in cases handled by the national courts: preliminary rulings. Finally, it provides selective examples of how Articles 101 and 102 TFEU are effectively applied at national level, thereby providing additional input into how problematic the issue of consistent application of EU competition law is in practice.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52535235936529,"sku":"NLS9783319837253","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319837253.jpg?v=1760670673"},{"product_id":"contents-and-effects-of-contracts-lessons-to-learn-from-the-common-european-sale-book-aurelia-colombi-ciacchi-9783319280721","title":"Contents and Effects of Contracts-Lessons to Learn From The Common European Sales Law","description":"This book presents a critical analysis of the rules on the contents and effects of contracts included in the proposal for a Common European Sales Law (CESL).","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52593139286289,"sku":"NLS9783319280721","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319280721.jpg?v=1761067260"},{"product_id":"eea-agreement-in-a-revised-eu-framework-for-welfare-services-book-karin-flistad-9783319950426","title":"The EEA Agreement in a Revised EU Framework for Welfare Services","description":"A broad range of welfare services are analysed, including public healthcare and educational services, various social services, and public utilities such as transport and public broadcasting.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52595164643601,"sku":"NLS9783319950426","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319950426.jpg?v=1761070622"},{"product_id":"beyond-networks-interlocutory-coalitions-the-european-and-global-legal-orders-book-gianluca-sgueo-9783319288734","title":"Beyond Networks - Interlocutory Coalitions, the European and Global Legal Orders","description":"This book explores the activism promoted by organised networks of civil society actors in opening up possibilities for more democratic supranational governance. It examines the positive and negative impact that such networks of civil society actors – named “interlocutory coalitions” – may have on the convergence of principles of administrative governance across the European legal system and other supranational legal systems.     The book takes two main controversial aspects into account: the first relates to the convergence between administrative rules pertaining to different supranational regulatory systems. Traditionally, the spread of methods of administrative governance has been depicted primarily against the background of the interactions between the domestic and the supranational arena, both from a top-down and bottom-up perspective. However, the exploration of interactions occurring at the supranational level between legal regimes is still not grounded on adequate empirical evidence. The second controversial aspect considered in this book consists of the role of civil society actors operating at the supranational level. In its discussion of the first aspect, the book focuses on the relations between the European administrative law and the administrative principles of law pertaining to other supranational regulatory regimes and regulators, including the World Bank, the International Monetary Fund, the World Trade Organization, the United Nations, the Organization for Economic Cooperation and Development, the Asian Development Bank, and the Council of Europe. The examination of the second aspect involves the exploration of the still little examined, but crucial, role of civil society organised networks in shaping global administrative law. These “interlocutory coalitions” include NGOs, think tanks, foundations, universities, and occasionally activists with no formal connections to civil society organisations. The book describes such interlocutory coalitions as drivers of harmonized principles of participatory democracy at the European and global levels. However, interlocutory coalitions show a number of tensions (e.g. the governability of coalitions, the competition among them) that may hamper the impact they have on the reconfiguration of individuals’ rights, entitlements and responsibilities in the global arena.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52596728168721,"sku":"NLS9783319288734","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319288734.jpg?v=1761073089"},{"product_id":"eea-agreement-in-a-revised-eu-framework-for-welfare-services-book-karin-flistad-9783030069612","title":"The EEA Agreement in a Revised EU Framework for Welfare Services","description":"This book addresses some of the most debated topics preceding the UK referendum on membership of the EU, namely welfare services and free movement of citizens. The first part clarifies the requirements on damages claims under both public procurement and general EU law, notably the public procurement remedies directives and doctrines such as procedural autonomy, effective judicial protection and Member State liability. The second part focuses on comparative law, covering England, France, Germany and the Netherlands, and provides an overview of national regulation and case law of damages litigation in the area of public procurement. A third part discusses the constitutive and quantification criteria of the damages remedy from a comparative and EU law perspective. It explores the lost chance, which functionally emerges as a compromise capable of mitigating the typically problematic nature of causation and uncertainty in public procurement constellations. The book concludes with a proposal for legislative intervention regarding damages in public procurement.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52598812082449,"sku":"NLS9783319236117","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319236117.jpg?v=1761076797"},{"product_id":"e-food-closing-the-online-enforcement-gap-in-the-eu-platform-economy-book-maria-jose-plana-casado-9783030795030","title":"E-FOOD: Closing the Online Enforcement Gap in the EU Platform Economy","description":"In fact, sector-specific legislation, including Food Law, largely ignores online transactions. The last few decades have seen a significant shift in the focus of this process: multilateralism seems to have reached its limits, giving way to regionalism, and the focus of trade liberalization has shifted to non-tariff barriers. While these developments have attracted considerable attention, exploring them from comparative perspectives has been largely neglected. Trading systems – the WTO, regional economic integrations and federal systems – are all based on the same dichotomy of free trade and local public interest: they generally prohibit the constituent parties (states) from restricting trade, but exempt them from this limitation if the restriction is warranted by a legitimate local end.      The purpose of this volume is to contribute to filling the above-mentioned research gap by exploring central issues in regional economic integrations from a comparativeperspective. It provides a general economic analysis of the costs and benefits of trade liberalization and the role and function of normative values in commercial policy. This is followed by a comparative analysis of the approaches used in various regional economic integrations (in North America, Europe and Latin America) and federal markets (the United States, Australia and India) regarding the balance between free trade and local public interest. Key issues in investment law, one of the most contentious elements of next-generation free trade agreements, are also addressed.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52615416348945,"sku":"NLS9783030419226","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783030419226.jpg?v=1761524002"},{"product_id":"modernisation-of-state-aid-for-economic-and-social-development-book-bruno-nascimbene-9783319992259","title":"The Modernisation of State Aid for Economic and Social Development","description":"This book analyses the recent modernisation of EU State aid law from various perspectives, and considers both substantive and procedural aspects.","brand":"WoB","offers":[{"title":"- \/ - \/ INTERNAL","offer_id":52655542042897,"sku":null,"price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ INGRAM","offer_id":52655542468881,"sku":"NLS9783319992259","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319992259.jpg?v=1762221114"},{"product_id":"legal-constraints-on-eu-member-states-in-drafting-accession-agreements-book-narin-idriz-9783031041044","title":"Legal Constraints on EU Member States in Drafting Accession Agreements","description":"Legal provisions, rules, principles and norms that might constrain Member States in this regard are identified with reference to the PSC.The book examines constraints on Member States stemming from three sources of EU law: Association Law, based on the existing legal framework built on the EEC-Turkey Association Agreement (Part I);","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52664182210833,"sku":"NLS9783031041044","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783031041044.jpg?v=1762273956"},{"product_id":"institutional-structure-of-macroprudential-policy-in-the-uk-book-kosmas-kaprinis-9783031335754","title":"The Institutional Structure of Macroprudential Policy in the UK","description":"Macroprudential policy (MPP) has been one of the major initiatives in the post-2008 crisis restructuring of financial regulation. Under the macroprudential mandate, the regulator monitors and judiciously controls systemic risk in the financial system, in an attempt to minimise the probability and severity of a future financial crisis. The book reveals why MPP authorities are rightfully at the centre of a highly sensitive policy debate, as MPP necessitates the allocation of significant regulatory power to technocrats, while the highly technical nature of MPP makes policy evaluation challenging. Specific issues examined include: the importance of financial stability as a public policy goal; the political economy issues stemming from the delegation of MPP to an independent authority; and the definition of accountability in the context of MPP. Focusing on a case study on the Financial Policy Committee of the Bank of England, the macroprudential authority in the UK, the book develops the normative grounds to justify the need for accountability in the conduct of MPP, while also formulating the necessary institutional framework to ensure the accountability of MPP authorities.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52669954228497,"sku":"NLS9783031335754","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783031335754.jpg?v=1762288602"},{"product_id":"cross-border-mergers-book-thomas-papadopoulos-9783030227555","title":"Cross-Border Mergers","description":"This edited volume focuses on specific, crucially important structural measures that foster corporate change, namely cross-border mergers. Such cross-border transactions play a key role in business reality, economic theory and corporate, financial and capital markets law. Since the adoption of the Cross-border Mergers Directive, these mergers have been regulated by specific legal provisions in EU member states. This book analyzes various aspects of the directive, closely examining this harmonized area of EU company law and critically evaluating cross-border mergers as a method of corporate restructuring in order to gain insights into their fundamental mechanisms. It comprehensively discusses the practicalities of EU harmonization of cross-border mergers, linking it to corporate restructuring in general, while also taking the transposition of the directive into account. Exploring specific angles of the Cross-border Mergers Directive in the light of European and national company law, thebook is divided into three sections: the first section focuses on EU and comparative aspects of the Cross-border Mergers Directive, while the second examines the interaction of the directive with other areas of law (capital markets law, competition law, employment law, tax law, civil procedure). Lastly, the third section describes the various member states’ experiences of implementing the Cross-border Mergers Directive.","brand":"WoB","offers":[{"title":"- \/ - \/ INTERNAL","offer_id":52672577995025,"sku":null,"price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ INGRAM","offer_id":52672578617617,"sku":"NLS9783030227555","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783030227555.jpg?v=1762294996"},{"product_id":"certification-trust-accountability-liability-book-peter-rott-9783030024987","title":"Certification  Trust, Accountability, Liability","description":"This book offers an in-depth analysis of the function of certification in general and of certification systems in a range of different sectors.    The authors examine certification from both a theoretical and a practical standpoint and from the perspectives of different disciplines, including law, economics, management, and the social sciences. They also discuss instruments that help ensure the quality of certification, which can range from public law measures such as accreditation, to private law incentives, to deterrents, such as liability towards victims. Further, they assess the role of competition between certification bodies.    Readers will learn the commonalities as well as the necessary distinctions between certification bodies in various fields, which may stem from the different functions they serve. These similarities and differences may also be the result of different types of damage that the certified producer or service provider could potentially causeto individuals or to the public at large.    Often, companies use certification bodies as an argument to assure the general public, e.g. regarding the safety of medical products. Closer inspection reveals, however, that sometimes certification bodies themselves lack credibility. The book offers essential information on the benefits and pitfalls associated with certification.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52674855928081,"sku":"NLS9783030024987","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783030024987.jpg?v=1762300565"},{"product_id":"empirical-views-on-european-gambling-law-and-addiction-book-simon-planzer-9783319023052","title":"Empirical Views on European Gambling Law and Addiction","description":"This book analyses the voluminous and meandering case law on gambling of the Court of Justice from an empirical perspective.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52676527194385,"sku":"NLS9783319023052","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319023052.jpg?v=1762304364"},{"product_id":"institutionalisation-beyond-the-nation-state-book-elaine-fahey-9783030095932","title":"Institutionalisation beyond the Nation State","description":"This volume collects papers that explore institutionalisation in contemporary transatlantic relations. Policymakers, lawyers, and political scientists reflect on contemporary understandings of the process as an integration of regimes and orders from an EU perspective. The papers assess whether contemporary transatlantic relations call for a different approach to global governance with a heightened emphasis on institutionalisation. The book explores a diverse range of case studies of interest to a broad readership. In particular, it focuses upon two cutting-edge issues: transatlantic data privacy rules that are emerging after the post-Edward Snowdon \/ NSA \/ PRISM revelations; and trade aspects, especially the Transatlantic Trade and Investment Partnership (TTIP) Agreement. The contributors consider these case studies from a variety of perspectives, honing in on the dynamism, method, and high politics of transatlantic relations as they have recently evolved. They critically explore the commonly held assumption that transatlantic relations have historically been considered quasi-institutionalised at best or, at worst, lacking in terms of laws and institutions. Is institutionalisation a useful meeting point for all disciplines? Does it explain regional integration meaningfully across subjects? Can institutionalisation serve to promote accountability and good governance?  Contributors across disciplines and subjects address these increasingly challenging and salient questions.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52677819302161,"sku":"NLS9783030095932","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783030095932.jpg?v=1762306750"},{"product_id":"sustainability-labels-in-the-shadow-of-the-law-book-eva-van-der-zee-9783030958046","title":"Sustainability Labels in the Shadow of the Law","description":"This book describes and examines three EU legal frameworks (EU competition law, EU consumer law, and EU fundamental rights law) that may affect the extent to which consumers purchase more sustainably. In doing so, this book goes beyond a rationalist understanding of the interpretation and application of EU law. Rational approaches have severely impacted the interpretation and application of EU law. Practice shows, however, that the implications of using a noncritical application of rationalist approaches in the interpretation and application of EU competition law, EU consumer law, and EU fundamental rights law to sustainability labels may have an inhibiting effect on sustainable consumption. The book offers remedies to overcome this inhibitive effect by critically applying insights from cognitive science and behavioral economics in the legal interpretation and application of EU law.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52684491587857,"sku":"NLS9783030958046","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783030958046.jpg?v=1762323160"},{"product_id":"world-trade-and-local-public-interest-book-csongor-nagy-9783030419196","title":"World Trade and Local Public Interest","description":"Trading systems  the WTO, regional economic integrations and federal systems  are all based on the same dichotomy of free trade and local public interest: they generally prohibit the constituent parties (states) from restricting trade, but exempt them from this limitation if the restriction is warranted by a legitimate local end.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52684869697809,"sku":"NLS9783030419196","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783030419196.jpg?v=1762324028"},{"product_id":"restrictions-of-eu-competition-law-in-the-digital-age-book-bernadette-zelger-9783031313387","title":"Restrictions of EU Competition Law in the Digital Age","description":"This book offers an in-depth legal analysis concerning the notion of restrictions of competition, be it by object restrictions according to Article 101 TFEU or prima facie abusive practices treated according to the form-based approach under Article 102 TFEU. Although extensive research has been conducted on the notion of object infringements of competition, there is no systematic review of this topic covering both competition provisions, namely Articles 101 and 102 TFEU. This book fills that gap by providing an extensive analysis of the relevant case law, while also covering new phenomena stemming from the digital revolution and its impact on the functioning of traditional markets.    In this regard, particular attention is paid to the concept of prima facie infringements and the analysis necessary for their successful establishment. Object restrictions and object abuses are not infringements per se in the sense that they can be established in the abstract and without consideration of the actual legal and economic context (context analysis) within which a measure is implemented. Hence, the indispensable context analysis is informed by the potential economic effects of a given measure.    Examining the changes regarding the economic reality and how markets work in the digital economy, this book makes a valuable contribution to the current debate about whether our competition law toolkit is fit and proper to deal with the challenges posed by digitalization. The author argues that while there is a coherent framework covering both Treaty competition provisions as regards object restrictions of competition, the increased use of an actual effect analysis and thus the concept of a restriction of competition by effect represents an underestimated (and underused) weapon for combating measures that are ambivalent from a competition law perspective as regards their (anticompetitive or non-detrimental) nature in a digital economy.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52687582658833,"sku":"NLS9783031313387","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783031313387.jpg?v=1762330852"},{"product_id":"impact-of-wto-sps-law-on-eu-food-regulations-book-chris-downes-9783319379227","title":"The Impact of WTO SPS Law on EU Food Regulations","description":"This book brings a fresh perspective on the emerging field of international food law with the first detailed analysis of the process and implications of domestic compliance with the World Trade Organisation (WTO) Sanitary and Phytosanitary (SPS) Agreement. It investigates the influence of WTO disciplines on the domestic policy-making process and examines the extent to which international trade law determines European Union (EU) food regulations.  Following controversial WTO rulings on genetically-modified foods and growth hormones in beef, awareness and criticism of global rules governing food has grown considerably. Yet the real impact of this international legal meta-framework on domestic regulations has remained obscure to practitioners and largely unexplored by legal commentators. This book examines the emergence of transnational governance practices set in motion by the SPS Agreement and their role in facilitating agricultural trade. In so doing, it complements and challenges conventional accounts of the SPS regime dominated by analysis of WTO disputes.  It reviews legal commentary of the SPS Agreement to understand why WTO rules are so commonly characterised as a significant threat to domestic food policy preferences. It then takes on these assumptions through an in-depth review of food policies and decision-making practices in the EU, revealing both the potential and limits of WTO law to shape EU policies. It finally examines two important venues for the generation of global food norms – the WTO SPS Committee and Codex Alimentarius – to evaluate the practice and significance of transnational governance in this domain. Through detailed case studies including novel foods, food additives, vitamin and mineral supplements and transparency and equivalence procedures, this book provides a richer account of compliance and exposes the subtle, but important influence of WTO obligations.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":53522399330577,"sku":"NLS9783319379227","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319379227.jpg?v=1778458164"}],"url":"https:\/\/www.worldofbooks.com\/collections\/studies-in-european-economic-law-and-regulation-book-series.oembed","provider":"World of Books ","version":"1.0","type":"link"}
