Since OLAF was set up in 1999, significant changes in its functional environment have taken place including in EU criminal law and especially in mutual assistance and substantive criminal law; the reconstruction of Eurojust and Europol through recent Regulations and Memoranda of Cooperation; and the entry into force of the Lisbon Treaty. The authors advance the view that OLAF's current legal framework must address these issues adequately. The approach they take is multi-disciplinary. OLAF is examined here through the prisms of EU politics and national, European and (to some extent) comparative law, focusing not only on the identification of current problems in regulation and procedure but also on its positioning within the context of European integration. Operational issues are then extensively discussed, making this a book for practitioners as well as policy makers and academics. The book addresses the theoretical and practical aspects of anti-fraud actions within both criminal and civil aspects of public law. Although OLAF works within an incomplete EU legal framework and with varying cooperation by national authorities, its staff have devised mechanisms that address some of these issues. Nevertheless, rules covering procedural and operational issues will need to be safeguarded within future legislation.","brand":"WoB","offers":[{"title":"US \/ GOOD \/ SBYB","offer_id":50391947444497,"sku":"CIN1574864467G","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ INGRAM","offer_id":52614550126865,"sku":"NLS9781841137919","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/184113791X_331c9647-8247-42fb-a902-4b6ce99b3651.jpg?v=1751280739"},{"product_id":"principles-of-indonesian-criminal-law-book-topo-santoso-9781509950928","title":"Principles of Indonesian Criminal Law","description":"This authoritative new work sets out the key tenets of the principles and process of criminal law in Indonesia. However, not much attention has been paid to other serious crimes, including narcotics-related offences, human trafficking and money laundering, which do not necessarily amount to international crimes in the traditional sense. The purpose of this monograph is to fill this gap and offer a critical analysis of developments in the field of transnational organised crime under international law. The book is divided into two parts. Part I is entitled \"Norms, Principles, and Concepts.\" It traces the history of organised crime and explores key concepts and norms relating to the practice from a multi-disciplinary perspective. It then looks at legal obligations imposed upon States as well as non-State actors in relation to transnational organised crime. Part II illustrates how these norms, principles and obligations are translated and enforced in practice. This will be done through case studies at the level of national law (Thailand, Serbia and the UK), regional law (European Union) and international law (United Nations). \"A book of many parts, its thematic coherence comes from its devotion to identifying the social threat posed by organised crime and the legal steps taken at the international and national levels against that threat. Rich with example and illustration and written in a light, direct, style, it will provide a lucid guide for practitioners, policy-makers and students to the largely untraversed territory of the international legal system set up to suppress transnational organised crime.\" Professor Neil Bolster, University of Canterbury, New Zealand. \"...the international law governing organized crime is a close relative of the body of law applicable to the International Criminal Court and similar institutions. It provides a forum to address issues of more general concern, such as the scope of universal jurisdiction, immunities, statutory limitation and extradition. Tom Obokata's study, with its original and in some ways unique perspective, enriches our knowledge of the field\". Professor William Schabas, Irish Centre for Human Rights. \"The book is well written, its documentation is quite exhaustive, and its thesis is timely and compelling.\" Professor M. Developments in technological resources, mass media and global communication have enabled groups such as Islamic State (IS) to merge an archaic religious ideology with resources of modernity creating a severely effective tool for recruitment. Up to 22,000 foreign fighters from more than 100 countries, including the UK, have been persuaded to join the ranks of the self-declared IS. Furthermore, the propagated ideology has served to create an environment where genocide can and has arguably already flourished. The book aims to understand the above-mentioned radical ideology, breaking it down to its foundations whilst assessing the key ideologues whose influences have shaped the beliefs of thousands throughout history. In this aspect it will be widely useful to counter-radicalisation efforts, increasing the capacity for preventing and controlling the process of violent radicalisation and providing a counter-narrative to the propaganda of extremist individuals and groups like IS.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51201411121425,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ GARDNERS","offer_id":51201413087505,"sku":"NGR9781509910533","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/1509910530.jpg?v=1750797232"},{"product_id":"principles-of-polish-criminal-procedure-book-jaroslaw-zagrodnik-9781509950812","title":"Principles of Polish Criminal Procedure","description":"Little is available in English on the procedural aspects of the Polish criminal justice system and the tenets of its criminal process. It also includes topics relating to the victims of crime and their role in criminal proceedings. Starting with pre-trial investigations (extending in particular to coercive measures and discretionary powers in the implementation of non-prosecution policies) the book continues as a guide through the basic principles of criminal trial, standards of evidence and rules related to conviction. German criminal law is a code-based model and has been for centuries. The influence of academic writing on its development has been far greater than in the judge-oriented common law models. The book will serve as a useful aid to debates about codification efforts in countries that are mostly based on a case law system, but who wish to re-structure their law in one or several criminal codes. The comparison will show that similar problems occur in all legal systems regardless of their provenance, and the attempts of individual systems at solving them, their successes and their failures, can provide a rich experience on which other countries can draw and on which they can build. The book provides an outline of the principles of German criminal law, mainly the so-called 'General Part' (eg actus reus, mens rea, defences, participation) and the core offence categories (homicide, offences against property, sexual offences). It sets out the principles, their development under the influence of academic writing and judicial decisions. The book is not meant as a textbook of German criminal law, but is a selection of interrelated in-depth essays on the central problems. Wherever it is apposite and feasible, comparison is offered to the approaches of English criminal law and the legal systems of other common and civil law countries in order to allow common lawyers to draw the pertinent parallels to their own jurisdictions.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52331065573649,"sku":"NLS9781841136301","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9781841136301.jpg?v=1758147242"},{"product_id":"concept-of-mens-rea-in-international-criminal-law-book-mohamed-elewa-badar-9781841137605","title":"The Concept of Mens Rea in International Criminal Law","description":"This book takes a comparative approach to find a unified approach to the doctrine of mens rea in the sphere of international criminal law.","brand":"WoB","offers":[{"title":"- \/ - \/ INTERNAL","offer_id":52346933543185,"sku":null,"price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ INGRAM","offer_id":52346937409809,"sku":"NLS9781841137605","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9781841137605.jpg?v=1758176949"},{"product_id":"caribbean-anti-trafficking-law-and-practice-book-jason-haynes-9781509946242","title":"Caribbean Anti-Trafficking Law and Practice","description":"This monograph investigates the International, European and Commonwealth Caribbean approaches to human trafficking from an Analytical Eclectic perspective. It presents a compelling, empirically based argument that although there is currently a panoply of measures aimed at preventing human trafficking, prosecuting offenders and protecting trafficked victims in both Europe and the Commonwealth Caribbean, these measures have in practice been fraught with a number of challenges, whether of a normative, institutional or individual nature. The continued existence of these challenges strongly suggests that there exists a ‘disconnect’ between anti-trafficking law and practice which is not peculiar to small-island developing States since they also extend to developed States, including the United Kingdom. Although these challenges are not insurmountable, this monograph advances the argument that sustained social, economic, political and legal commitments are both necessary and desirable, and that without such commitments, only pyrrhic victories would be won in the fight to eradicate the scourge of the twenty-first century. Given the importance of the issue of human trafficking and its inescapable impact on victims, families, communities, nations, regions and the international community as a whole, this monograph will serve as an important resource for policy makers, scholars, students and practitioners actively working in this increasingly dynamic area of law.","brand":"WoB","offers":[{"title":"- \/ - \/ INTERNAL","offer_id":52431081898257,"sku":null,"price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ INGRAM","offer_id":52431082553617,"sku":"NLS9781509946242","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9781509946242.jpg?v=1759171482"},{"product_id":"crime-procedure-and-evidence-in-a-comparative-and-international-context-book-john-d-jackson-9781841136820","title":"Crime, Procedure and Evidence in a Comparative and International Context","description":"This book aims to honour the work of Professor Mirjan Damaska, Sterling Professor of Law at Yale Law School and a prominent authority for many years in the fields of comparative law, procedural law, evidence, international criminal law and Continental legal history. Professor Damaska 's work is renowned for providing new frameworks for understanding different legal traditions. To celebrate the depth and richness of his work and discuss its implications for the future, the editors have brought together an impressive range of leading scholars from different jurisdictions in the fields of comparative and international law, evidence and criminal law and procedure. Using Professor Damaska's work as a backdrop, the essays make a substantial contribution to the development of comparative law, procedure and evidence. After an introduction by the editors and a tribute by Harold Koh, Dean of Yale Law School, the book is divided into four parts. The first part considers contemporary trends in national criminal procedure, examining cross-fertilisation and the extent to which these trends are resulting in converging practices across national jurisdictions. The second part explores the epistemological environment of rules of evidence and procedure. The third part analyses human rights standards and the phenomenon of hybridisation in transnational and international criminal law. The final part of the book assesses Professor Damaska 's contribution to comparative law and the challenges faced by comparative law in the twenty first century.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52435029688593,"sku":"NLS9781841136820","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ GARDNERS","offer_id":53117482369297,"sku":"NGR9781841136820","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9781841136820.jpg?v=1759182313"},{"product_id":"concept-of-mens-rea-in-international-criminal-law-book-mohamed-elewa-badar-9781849469142","title":"The Concept of Mens Rea in International Criminal Law","description":"This is an endeavour to find a unified approach to the doctrine of mens rea in the sphere of international criminal law, based on an in-depth comparative analysis of the world’s major legal systems and the jurisprudence of international criminal tribunals. That this is true is emphasised by the ever-increasing amount of legislation stemming from the European Union (EU) which impacts, both directly and indirectly, on the criminal law. The involvement of the EU institutions in the substantive criminal laws of its Member States is of considerable legal and political significance. This book deals with the emerging EU framework for creating, harmonising and ensuring the application of EU criminal law. This book aims to highlight some of the consequences of EU involvement in the criminal law by examining the provisions which have been adopted in the field of information and communications technology. It provides an overview of the criminal law competence of the EU and evaluates the impact of these developments on the criminal laws of the Member States. It then goes on to consider the EU legislation which requires Member States to regulate matters such as data protection, e-security, intellectual property and various types of illegal content through the criminal law is analysed. In the course of this evaluation, particular consideration is given to issues such as the basis on which the EU institutions establish the need for criminal sanctions, the liability of service providers and the extent to which the Member States have adhered to, or departed from, the legislation in the course of implementation.","brand":"WoB","offers":[{"title":"- \/ - \/ INTERNAL","offer_id":52485397381393,"sku":null,"price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ INGRAM","offer_id":52485398233361,"sku":"NLS9781841137278","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9781841137278.jpg?v=1759857655"},{"product_id":"transitional-justice-and-the-prosecution-of-political-leaders-in-the-arab-region-book-noha-aboueldahab-9781509911332","title":"Transitional Justice and the Prosecution of Political Leaders in the Arab Region","description":"The dramatic uprisings that ousted the long-standing leaders of several countries in the Arab region set in motion an unprecedented period of social, political and legal transformation. The prosecution of political leaders took centre stage in the pursuit of transitional justice following the ‘Arab Spring’. Through a comparative case study of Egypt, Libya, Tunisia and Yemen, this book argues that transitional justice in the Arab region presents the strongest challenge yet to the transitional justice paradigm. This paradigm is built on the underlying assumption that transitions constitute a shift from non-liberal to liberal democratic regimes, where often legal measures are taken to address atrocities committed during the prior regime. The book is guided by two principal questions: first, what trigger and driving factors led to the decision of whether or not to prosecute former political leaders? And second, what shaping factors affected the content and extent of decisions regarding prosecution? In answering these questions, the book enhances our understanding of how transitional justice is pursued by different actors in varied contexts. In doing so, it challenges the predominant understanding that transitional justice uniformly occurs in liberalising contexts and calls for a re-thinking of transitional justice theory and practice. Using original findings generated from almost 50 interviews across 4 countries, this research builds on the growing critical literature that claims that transitional justice is an under-theorised field and needs to be developed to take into account non-liberal and complex transitions. It will be stimulating and thought-provoking reading for all those interested in transitional justice and the ‘Arab Spring’.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52534878011665,"sku":"NLS9781509936403","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9781509936403.jpg?v=1760669630"},{"product_id":"principles-of-chinese-criminal-procedure-book-liling-yue-9781509934911","title":"Principles of Chinese Criminal Procedure","description":"This book presents a short history and timeline of criminal procedure legislation in China. First, it addresses the status of Human Rights Conventions and the challenges resulting from human rights standards for Chinese criminal procedural law and practice. The discussion then moves on to explore the fundaments of Chinese criminal procedure such as the applicable law found in the Chinese CPL (Criminal Procedure Law) and legal institutions. The book covers relevant actors in the Chinese Criminal Justice System (ie judges, prosecutors, police, defence councils) as well as the relationships between them. Appeals and the issue of reopening criminal proceedings are also considered, with the book making particular reference to a number of special procedures (including juvenile delinquency) in the closing chapter.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52537898926353,"sku":"NLS9781509934911","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9781509934911.jpg?v=1760679967"},{"product_id":"principles-of-german-criminal-procedure-book-michael-bohlander-9781509935338","title":"Principles of German Criminal Procedure","description":"The new edition of this seminal text outlines the fundamental aspects of the German approach to criminal procedure. As far as it is useful for an introductory text, the differences between proceedings against adults and juveniles are highlighted. In contrast to sentencing in domestic jurisdictions, and in spite of its growing importance, sentencing law is a part of international criminal law that is still 'under construction' and is unregulated in many aspects. International sentencing law and practice is not yet defined by exact norms and principles and as yet there is no body of international principles concerning the determination of sentence, notwithstanding the huge volume of sentencing research and the extensive modern debate about sentencing principles. Moreover international judges receive very little guidance in sentencing matters: this contributes to inconsistencies and may increase the risk that similar cases will be sentenced in different ways. One purpose of this book is to investigate and evaluate the process of international sentencing, especially as interpreted by the ICTY and the ICTR, and to suggest a more comprehensive and coherent system of guiding principles, which will foster the development of a law of sentencing for international criminal justice. The book discusses the law and jurisprudence of the ad hoc Tribunals, and also presents an empirical analysis of influential factors and other data from ICTY and ICTR sentencing practice, thus offering quantitative support for the doctrinal analysis. This publication is one of the first to be entirely devoted to the process of sentencing in international criminal justice. The book will thus be of great interest to practitioners, academics and students of the subject.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52608827457809,"sku":"NLS9781849461160","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9781849461160.jpg?v=1761346665"},{"product_id":"amicus-curiae-in-international-criminal-justice-book-sarah-williams-9781509954704","title":"The Amicus Curiae in International Criminal Justice","description":"The amicus curiae – or friend of the court – is the main mechanism for actors other than the parties, including civil society actors and states, to participate directly in proceedings in international criminal tribunals. Yet reliance on this mechanism raises a number of significant questions concerning: the functions performed by amici, which actors seek to intervene and why, and the influence of amicus interventions on judicial outcomes. Ultimately, the amicus curiae may have a significant impact on the fairness, representativeness and legitimacy of the tribunals’ proceedings and decisions. This book provides a comprehensive examination of the amicus curiae practice of the International Criminal Court and other major international criminal tribunals and offers suggestions for the role of the amicus curiae. In doing so, the authors develop a framework to augment the potential contributions of amicus participation in respect of the legitimacy of international criminal tribunals and their decisions, while minimising interference with the core judicial competence of the tribunal and the right of the accused to a fair and expeditious trial.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52614377046289,"sku":"NLS9781509954704","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9781509954704.jpg?v=1761521050"},{"product_id":"principles-of-german-criminal-procedure-book-michael-bohlander-9781509948246","title":"Principles of German Criminal Procedure","description":"The new edition of this seminal text outlines the fundamental aspects of the German approach to criminal procedure.
