This book examines how these principles are implemented in a variety of settings: in national courts of selected jurisdictions, international courts and international arbitration.

The book collates special reports which address the topical issues currently under debate, such as the need to preserve the adjudicator's independence from the other powers of the state, and the need to preserve the legitimacy of arbitration in investor-state disputes. Rapporteurs also examine topics such as the standard required for independence and impartiality, the selection criteria and the selection method, the authority in charge of making the selection (a party appointment or an appointing authority), the mechanisms to counter-balance the influence that may be exercised by the appointing authority, the adjudicator's duty of disclosure, the adjudicator's immunity, the adjudicator's rights and duty after the term of service, codes of conduct, and the consequences of a breach of the different duties.

The general report provides a comparative analysis of the mechanisms implemented in the various systems, and highlights their similarities and differences. The analysis refutes some of the assumptions commonly made in the ongoing debate on the reform of the mechanism for individual-state dispute resolution, especially for investment arbitration. In particular, the comparative analysis of the mechanisms used within international courts does not confirm the assumption that a permanent court would resolve issues of legitimacy that are currently discussed in connection with investment arbitration (such as conflict of interests, double-hatting and issue conflict).

Giuditta Cordero-Moss is Professor at the University of Oslo, Norway and President of the International Academy of Comparative Law. The contributions consider two main issues. The first is whether family law recognises that a child can have multiple parents. The focus falls on stepfamilies; families where children are raised in more than one household because, for example, their parents jointly exercise custody after separation or have never shared a household but share parenting responsibilities; polygamous families; families where children have been adopted but maintain links with their biological families; families where children are cared for in terms of a kafala arrangement; families where a child was born as a result of donor-assisted reproductive technology using one male and one female gamete; families where a child was born as a result of 'three-parent' medical technology; and families where a child was born as a result of surrogacy. The contributions show that, in most of the jurisdictions, family law recognises a maximum of two legal parents and that, in some jurisdictions, those two parents must be one female person and one male person. Except in the case of surrogacy, the two legal parents are usually the woman who gives birth to the child and her spouse/partner. In some jurisdictions, multiple parents are recognised to some degree after adoption. Multiple parents are not recognised in the case of kafala but they are recognised in polygamous families in some jurisdictions. The second main issue is which family functions are recognised and favoured by the law, and whether the presence of children in the family makes a difference in this regard. The main functions identified in the contributions are the provision of economic security and financial support to children and economically weaker family members; having and raising children; being a place where people take care of each other; providing a special bond to the members of the family; and being a refuge of love and companionship. The two functions which predominate are the provision of economic security and financial support to children and economically weaker family members, and having and raising children. Generally, the family's functions are not viewed differently depending on whether or not the family includes children. However, if the family does include children, the function of raising children may be elevated above the other functions and the scope of the provisions of economic security and financial support and of caretaking responsibilities is increased.

JACQUELINE HEATON is a professor who lectures Family Law at the University of South Africa. Drawing these boundaries is a permanent process, which produces universal legal problems of fundamental practical importance. This book addresses the fundamental importance of the protection of the individual from potential actions of state bodies that violate legally marked boundaries. Contributors synthesize knowledge about the admissibility of evidence in criminal procedure, evidence that must not be used or should not be used under certain circumstances, and the conditions for the admissibility of unlawfully obtained evidence. The scale and complexity of the task is daunting. The law is called upon to enable and even encourage the advent of this revolution, while guaranteeing a fair allocation of the resulting risks and ensuring public safety. What's more, the law must rise to this challenge at a time when it is impossible to predict in the medium term the speed at which autonomous vehicles will enter circulation, or even their degree of autonomy. Adapting civil liability law appears to be the key to success. Faced with the peculiarities of autonomous vehicles, many concepts on which current liability regimes are based will need rethinking. For instance, the complex manufacturing of driving systems multiplies the number of potential liable parties, and the "black box" effect associated with the operation of learning AI increases the burden of proof in the event of a failure.
On the internet, music, films and TV shows are now just a few clicks away, readily available for listening or viewing. Climate change has been both a manifestation and an effect of the development of the biosphere, which has influenced the evolution of our civilization. It is necessary to postulate an intensification of research on the integration of environmental and climate change adaptation issues in legal and agricultural regulation. The planned research will provide opportunity to verify the hypothesis that the regulation of environmental conditions for agriculture is evolving from specific solutions, protecting the availability of basic natural resources for agricultural production, to a more systemic approach in which agricultural inputs are treated as part of the biosphere and climate change-adapted agriculture must meet the growing food needs of a growing world population.
Over the past two decades, various jurisdictions around the world have created new specialised domestic courts to manage international commercial disputes.
