The work intervenes at the nexus of anthropological, historical, legal, developmental, and human rights literatures to offer fresh insights into extrajudicial violence and global migration. Taking witchcraft-based asylum cases as its focal point, it argues that the recent dramatic expansion in claims to refugee protection under the ‘particular social group’ category of the 1951 UN Refugee Convention reflects immigration authorities’ increasing willingness to consider how legally recognizable persecution can derive from cultural practices and beliefs. Reflecting critically on such cases, it advances understandings of how witchcraft beliefs and practices have persisted as significant engines of violence in the contemporary world. It sheds light both on the limits of legal pluralism and cultural relativism in asylum adjudication and on how social scientific expertise contributes not simply to the flow of ideas, but also to the channelling of people across national, cultural, and epistemological boundaries. The book will be essential reading for students and researchers in legal anthropology, African studies, human rights, transnational history, migration and refugee law and policy, and the history and anthropology of witchcraft.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51095406772497,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":51095409525009,"sku":"NIN9781032128474","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52587986157841,"sku":"NLS9781032128474","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/103212847X.jpg?v=1750790675"},{"product_id":"redesigning-justice-for-plural-societies-book-katayoun-alidadi-9781032123516","title":"Redesigning Justice for Plural Societies","description":"This volume examines cases of accommodation and recognition of minority practices: cultural, religious, ethnic, linguistic or otherwise, under state law. This book analyses the novel constellations of governance actors and conditions under which they interact and compete. The work follows a spatial approach as the emphasis on normative spaces opens avenues to better understand power relations, processes of institutionalization, and the production of legitimacy and normativities themselves. Selected case studies from thirteen African countries deliver new empirical data and grounded insights from, and into, particular normative spaces. The individual chapters explore the interrelationships between various normative orders, diverse actors, and their influences. The encounters between different normative understandings and actors open up space and multiple forums for negotiating values. The authors analyse how different doctrines, institutions, and practices are constructed, contested, negotiated, and adapted in translation processes and thereby continuously reshape Africa’s multidimensional normative spaces. The volume delivers nuanced views of jurisprudence in Africa and presents an excellent resource for scholars and students of anthropology, legal geography, legal studies, sociology, political sciences, international relations, African studies, and anyone wishing to gain a better understanding of how legal constellations are shaped by unreflected assumptions about the state and the rule of law.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51181980516625,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":51181982712081,"sku":"NIN9781032235608","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52430037385489,"sku":"NLS9781032235608","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/1032235608.jpg?v=1750790837"},{"product_id":"trials-and-triumphs-of-teaching-legal-anthropology-book-marie-claire-foblets-9781138308336","title":"The Trials and Triumphs of Teaching Legal Anthropology","description":"This volume addresses practical concerns of how to create space for legal anthropology in both law and anthropology programmes, and also more conceptual issues such as the ethnographic examination of the 'culture' of legal institutions and systems of state laws. It is based on testimonies from anthropologists teaching in anthropology departments, and legal scholars incorporating anthropology into their law curricula, and teaching fundamental aspects of legal thinking to anthropology students. Starting from an acknowledgement that anthropologists and lawyers still often regard one another with a degree of suspicion, the authors try to bridge the apparent epistemological and ontological gulf separating the disciplines. They do so by emphasizing both the need for law students to go beyond the standard approach to law based on state-centred positivism and open their eyes to the normative diversity that exists in all plural societies. At the same time, they stress the need for anthropologists to have a solid foundation in law, legal practice, and legal procedure to more effectively deal with a number of explicitly legal issues that are emerging as important concerns to anthropologists. The collection also addresses the issue of preparing anthropologists to apply their expertise in legal settings as expert witnesses and consultants.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51201393721617,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ GARDNERS","offer_id":51201395294481,"sku":"NGR9781138308336","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/1138308331.jpg?v=1751175035"},{"product_id":"african-witchcraft-and-global-asylum-seeking-book-katherine-luongo-9781032128542","title":"African Witchcraft and Global Asylum-Seeking","description":"This book analyzes how over the last two decades, immigration regimes in three primary refugee-receiving states in the Global North – Canada, Australia, and the United Kingdom – have engaged with allegations about witchcraft-driven violence made by asylum seekers coming from Anglophone countries across the African continent. As such it sheds light on a much neglected and contested topic. Arising in the context of recent legal and political debates that question the legitimacy of non-state actors engaged in dispute processing, the book explores the nature, form, and functioning of such forums and actors in two locations in rural India. Focusing on a fishermen’s community belonging to the caste of Hindu Machimār Koḷīs in coastal Maharashtra and an agrarian community in Uttarakhand with members from the Pandit, Thakur, Bhotiā, and Harijan caste groups, this study shows the manner in which non-state forums and actors engage with state law and its regulatory systems.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52337619665169,"sku":"NLS9781138625211","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9781138625211.jpg?v=1758167218"},{"product_id":"state-law-dispute-processing-and-legal-pluralism-book-kalindi-kokal-9780367726829","title":"State Law, Dispute Processing And Legal Pluralism","description":"This book presents an ethnography of dispute processing by non-state forums and actors in rural India.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52427164877073,"sku":"NLS9780367726829","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9780367726829.jpg?v=1759160151"},{"product_id":"anthropological-expertise-and-legal-practice-book-marie-claire-foblets-9780367540661","title":"Anthropological Expertise and Legal Practice","description":"This book draws on concrete cases of collaboration between anthropologists and legal practitioners to critically assess the use of anthropological expertise in a variety of legal contexts from the point of view of the anthropologist as well as of the decision-maker or legal practitioner. The contributions, several of which are co-authored by anthropologist–legal practitioner tandems, deal with the roles of and relationships between anthropologists and legal professionals, which are often collaborative, interdisciplinary, and complementary. Such interactions go far beyond courts and litigation into areas of law that might be called ‘social justice activism’. They also entail close collaboration with the people –often subjects of violence and dispossession –with whom the anthropologists and legal practitioners are working. The aim of this collection is to draw on past experiences to come up with practical methodological suggestions for facilitating this interaction and collaboration and for enhancing the efficacy of the use of anthropological expertise in legal contexts. Explicitly designed to bridge the gap between theory and practice, and between scholarship and practical application, the book will appeal to scholars and researchers engaged in anthropology, legal anthropology, socio-legal studies, and asylum and migration law. It will also be of interest to legal practitioners and applied social scientists, who can glean valuable lessons regarding the challenges and rewards of genuine collaboration between legal practitioners and social scientists.
