Ivana Bacik examines the shape and nature of the new Ireland, discussing such contentious topics as: the make-up of the modern family, organized religion, modern sexuality, reproductive rights, equality, racism, censorship and the environment, and the central role of the legal system in formulating a framework for our changing social mores. The book shows how Irish society has evolved to its current incarnation, and where it might go from here.","brand":"WoB","offers":[{"title":"GB \/ GOOD \/ INTERNAL","offer_id":49609982869777,"sku":"GOR002378167","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ VERY_GOOD \/ INTERNAL","offer_id":49638582550801,"sku":"GOR002090296","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ WELL_READ \/ INTERNAL","offer_id":50149257117969,"sku":"GOR002154753","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/0862788609.jpg?v=1751107661"},{"product_id":"legal-cases-that-changed-ireland-book-ivana-bacik-9781905536856","title":"Legal Cases That Changed Ireland","description":"Legal Cases that Changed Ireland examines key legal cases which have brought about significant social change in Ireland. The book is based on the 2015 project, entitled 'Changing Ireland, Changing Law, ' which involved a series of seminars under four themes exploring the relationship between legal action and social change. The four themes included: Women Changing Law, Changing Society; Sexual Identity, Law and Social Change; Immigration, Asylum and Legal Change; and Public Interest Litigation: Does it Work? Under each theme, a perspective is also provided by key non-governmental organizations that supported or initiated strategic legal cases, namely the Public Interest Law Alliance, the National Women's Council of Ireland, the Gay and Lesbian Equality Network, and the Immigrant Council of Ireland. While the changing nature of society is evident every day in our courtrooms, it is only in exceptional cases that we hear the stories behind moments of legal change. This book documents not only the stories of the legal cases themselves, but also the experiences of individuals who have taken cases of social importance.  Recognizing that it is not only cases heard in the superior courts resulting in judgments pored over by constitutional lawyers than can shape people's lives in profound ways, this book also supports the sharing of experiences of cases in other legal venues, such as the Equality Tribunal. These stories assist us to understand more about the nature of legal processes. It challenges the ‘sex work’ perspective, drawing on experience from rape law and #MeToo campaigns in Ireland and elsewhere to develop a new legal concept of ‘compromised consent’.   This concept justifies the introduction of Nordic Model laws banning the purchase of sex. It recognises that an individual consent to sell sex is necessarily compromised by structural exploitation within the vastly profitable global sex industry.   While ‘sex work’ proponents increasingly dominate academic discourse on prostitution, this book asserts that they have co-opted the language of feminism to mask the immense power and patriarchal control exerted by the industry. Their view of ‘consent’ is based on a dangerous premise. They cannot say that those who sell sex do so out of mutual desire; rather consent is portrayed as an expression of individual choice, thus ignoring the intersectional gendered collective context within which commercial sex transactions take place worldwide.   By contrast, this book argues that presumptions of ‘consent’ in prostitution directly undermine the legal principles of affirmative consent and contemporary law reforms hard-won by feminist activists on rape and gender-based violence. A view of consent as ‘compromised’ within the sex trade derives from socialist theorising, as well as from legal re-conceptualisations of consent in other settings. It also reflects the reality of conditions within the sex industry.  This book will be of great interest to students, academics, policy makers and feminist activists. It makes a significant contribution in challenging the dominant thinking within a highly polarised literature.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ GARDNERS","offer_id":53077971763473,"sku":"NGR9781509996742","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9781509996742.jpg?v=1772706226"}],"url":"https:\/\/www.worldofbooks.com\/en-ie\/collections\/author-books-by-ivana-bacik.oembed","provider":"World of Books ","version":"1.0","type":"link"}
