Although the judicial review of legislation is increasingly common in modern societies, it is not a finished project. This device still raises questions as to whether judicial review is justified, and how it may be structured. Yet, judicial review's justification and its scope are seldom addressed in the same study, thereby making for an inconvenient divorce of these two related avenues of study. To narrow the divide, the object of this work is quite straightforward. Namely, is the idea of judicial review defensible, and what influences its design and scope? This book addresses these matters by comparing the judicial review of legislation in the United Kingdom (the Human Rights Act of 1998), the Netherlands (the Halsema Proposal of 2002) and the Constitution of South Africa of 1996. These systems present valuable material to study the issues raised by judicial review. The Netherlands is of particular interest as its Constitution still prohibits the constitutional review of acts of parliament, while allowing treaty review of such acts. The Halsema Proposal wants to even out this difference by allowing the courts also to apply constitutional norms to legislation and not only to international norms. The Human Rights Act and the South African Constitution also present interesting questions that will make their study worthwhile. One can think of the issue of dialogue between the legislature and the judiciary. This topic enjoys increased attention in the United Kingdom but is somewhat underexplored in South African thought on judicial review. These and similar issues are studied in each of the three systems, to not only gain a better understanding of the systems as such, but also of judicial review in general.","brand":"WoB","offers":[{"title":"GB \/ VERY_GOOD \/ INTERNAL","offer_id":49643885658385,"sku":"GOR013608849","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52435140280593,"sku":"NLS9789048190010","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":52763120271633,"sku":"NIN9789048190010","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9048190010.jpg?v=1751319451"},{"product_id":"climate-change-and-the-law-book-erkki-j-hollo-9789400754393","title":"Climate Change and the Law","description":"The first scholarly effort to offer a systematic examination of doctrinal issues in climate law, this book explores the diverse international, regional, national, sub-national and transnational legal responses to climate change. It fills the gap in current legal research and positions local government in federal studies through the lenses of comparative law, adopting a more nuanced approach to local government. The book considers the shortcomings between the black-letter constitution and its operational rules. Whether (and how) the regime of local government is implemented is more relevant than its formal-but-ineffective recognition. The comparative survey discloses the variety local institutions take in different federal contexts. Divided into three parts, the book comprises chapters investigating local government in systems that, to various degrees, have been examined and classified as federal. Scholars throughout the world have examined the federal-local connection in aggregative federations, (the USA, Canada, Switzerland, Germany, Australia, and Austria), devolutionary ones (Belgium, Bosnia Herzegovina, Italy, Spain, the UK, Argentina, Brazil, Mexico, and the Russian Federation), as well as in federations beyond the West, where federalism-as-a-colonial-legacy has undergone a process of reinvention affecting the federal-local connection (South Africa, Ethiopia, India, Nigeria, Comoros, Democratic Republic of Congo, Nepal, Palau, Federated States of Micronesia; St. Kitts and Nevis; United Arab Emirates; and Pakistan).","brand":"WoB","offers":[{"title":"US \/ GOOD \/ SBYB","offer_id":50397308158225,"sku":"CIN3031417917G","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52122687078673,"sku":"NLS9783031417917","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/3031417917.jpg?v=1750729287"},{"product_id":"unamendable-constitution-book-richard-albert-9783319951409","title":"An Unamendable Constitution?","description":"This book examines the subject of constitutional unamendability from comparative, doctrinal, empirical, historical, political and theoretical perspectives. It explores and evaluates the legitimacy of unamendability in the various forms that exist in constitutional democracies. Modern constitutionalism has given rise to a paradox: can a constitutional amendment be unconstitutional? Today it is normatively contested but descriptively undeniable that a constitutional amendment—one that respects the formal procedures of textual alteration laid down in the constitutional text—may be invalidated for violating either a written or unwritten constitutional norm. This phenomenon of an unconstitutional constitutional amendment traces its political foundations to France and the United States, its doctrinal origins to Germany, and it has migrated in some form to all corners of the democratic world. One can trace this paradox to the concept of constitutional unamendability. Constitutional unamendability can be understood as a formally entrenched provision(s) or an informally entrenched norm that prohibits an alteration or violation of that provision or norm. An unamendable constitutional provision is impervious to formal amendment, even with supermajority or even unanimous agreement from the political actors whose consent is required to alter the constitutional text. Whether or not it is enforced, and also by whom, this prohibition raises fundamental questions implicating sovereignty, legitimacy, democracy and the rule of law.","brand":"WoB","offers":[{"title":"US \/ GOOD \/ SBYB","offer_id":50397331325201,"sku":"CIN3319951408G","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52479818891537,"sku":"NLS9783319951409","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/3319951408.jpg?v=1750998954"},{"product_id":"making-of-the-civil-codes-book-michele-graziadei-9789811949920","title":"The Making of the Civil Codes","description":"The book provides in-depth analysis of the new perspectives on codifications, and of the related reforms, that give recognition to new ideas, new needs, and new techniques. It then establishes common principles, where possible, as well as a set of general “soft law” principles governing international commercial contracts in these countries. The importance of commercial transactions in the BRICS countries is rapidly growing, yet differences in contract law among these countries can lead to misunderstandings and disputes. The rapid development of the BRICS instruments (and the legal implications of their use) suggests the need to address common legal issues that could harm the continued development of the BRICS economies. Contract law represents one of the core areas in which this process can take place. Addressing the salient legal issues within the BRICS discourse requires a comprehensive, comparative approach that explores the different solutions provided by each member country, in order to identify similarities and convergences. This process may ultimately help to reduce the legal obstacles to, and indirect costs of, cross-border transactions by offering a transparent and predictable legal environment for any future attempt at adopting common legal instruments.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ GARDNERS","offer_id":50769098473745,"sku":"NGR9783031008436","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":51064600461585,"sku":"NIN9783031008436","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52144308748561,"sku":"NLS9783031008436","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/303100843X.jpg?v=1751189941"},{"product_id":"vindicatory-justice-book-ignasi-saborit-9783030795948","title":"Vindicatory Justice","description":"This volume offers a new theoretical approach to the analysis of the law\/revenge binary, and attempts to dismantle the common idea of revenge as lacking any legal, moral or rational dimension. In contrast, the book puts forward a model of a complex system of justice—which it terms 'vindicatory'—wherein vendetta constitutes an authorized action, the core of which does not (just) lie in vengeance but also in settlement procedures for peace—or 'composition.' The first part of the book (\"Vindicatory Justice: Conceptual Analyses and Forerunners\") seeks to identify the nature of vindicatory justice and to shed light on the structure of so-called vindicatory systems. In turn, the second part (\"Mapping Vindicatory Justice\") illustrates, using examples gathered from a range of sociolegal contexts, the dynamic relationship between composition and authorized revenge in vindicatory systems. Taken as a whole, the volume shows that applying a longue durée historical perspective to the study of revenge systems allows us to clearly recognize composition and authorized revenge as features of the same legal system, even though one of them may seem predominant (or more eye-catching) than the other in certain cultural settings.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51060165214481,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":51060167803153,"sku":"NIN9783030795948","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52402067177745,"sku":"NLS9783030795948","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/3030795942.jpg?v=1751095081"},{"product_id":"criminal-law-and-morality-in-the-age-of-consent-book-aniceto-masferrer-9783030641627","title":"Criminal Law and Morality in the Age of Consent","description":"This book discusses the relation between morality and politics, and morality and law, a field that has been studied for more than two thousand years The law is a part of human culture, and this touches upon a dynamic reality that is connected to the relation between nature and freedom, nature and culture. If such relations are not clearly understood, as is the case today, the relation between morality and law cannot be properly comprehended either. The relationship between morality and criminal law must constantly evolve to meet the needs of changing times and circumstances. Social changes and new situations require new answers. And since the relationship involves criminal law, legal philosophy and legal history, interdisciplinary approaches are always needed. Featuring fifteen original contributions by legal scholars from various European and American universities, the book does not pretend to solve the complexity of the relation between morality and criminal law, but instead expresses criticism, offers some proposals and stimulates further thought. The book tackles the topic from an interdisciplinary perspective (criminal law, constitutional law, legal philosophy and legal history, among others). As such, it appeals not only to scholars and students, but also to lawyers, policymakers, historians, theologians, philosophers and general readers who are interested in the legal, social, political and philosophical issues of our time.","brand":"WoB","offers":[{"title":"US \/ NEW \/ INGRAM","offer_id":51061409808657,"sku":"NIN9783030641627","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52431914074385,"sku":"NLS9783030641627","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/3030641627.jpg?v=1750966573"},{"product_id":"financial-inclusion-and-digital-transformation-regulatory-practices-in-selected-book-howard-chitimira-9783031238628","title":"Financial Inclusion and Digital Transformation Regulatory Practices in Selected SADC Countries","description":"This book investigates the regulation and promotion of financial inclusion and provides a comparative analysis of the regulation, promotion and enforcement of the relevant laws in the SADC (in particular, South Africa, Namibia, Botswana and Zimbabwe), as well as the challenges of financial inclusion. Yet it remains arguably the most pressing question of law that faces the international community. This book unravels the legal and factual complications which have obscured the answer to this question. In contrast to most other works, it takes an historic approach by tracing the evolution of the rights, rules and principles of international law which have governed the use of force by states since the 16th century. Its emphasis on self-defence provides the reader with a new and complete understanding of how and why the international legal framework limits defensive force to repelling an imminent threat or use of offensive force which is directed at the territory of a state.   Taking an historic approach enables this book to resurrect an understanding of the human defensive instinct which has guided the formation of the international law of self-defence. It also explains the true legal nature and scope of the inherent right of self-defence, of anticipatory self-defence and provides a definition of the legal commencement of an armed attack for the purpose of Article 51 of the Charter. Finally, the reader will receive a unique source of research materials and analysis of state practice and of scholarly works concerning self-defence and the use of force since the 16th century, which is suitable for all readers of international law around the world.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51066662420753,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":51066667008273,"sku":"NIN9789401784856","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ INGRAM","offer_id":52145416962321,"sku":"NLS9789401784856","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/940178485X.jpg?v=1751254763"},{"product_id":"dialogues-on-human-rights-and-legal-pluralism-book-colleen-sheppard-9789400798120","title":"Dialogues on Human Rights and Legal Pluralism","description":"Human rights have transformed the way in which we conceive the place of the individual within the community and in relation to the state in a vast array of disciplines, including law, philosophy, politics, sociology, geography. National legal systems, which usually have no extraterritorial authority, remain insufficient to regulate the activities of multinational corporate groups, which operate worldwide, not only in the countries where the parent companies reside (home country), but also in countries where the subsidiaries operate (host countries). The mentioned lack of an effective legislation leads to an unjust imbalance – to the benefit of multinational corporate groups and to the detriment, especially, of involuntary creditors, such as tort victims of corporate activities, which predominantly concern human rights abuses and environmental violations. Against this backdrop, the book firstly assesses the position of multinational corporate groups in international law and then discusses potential reforms to corporate law that would allow for a multi-stakeholder approach. It analyses certain aspects of Turkish tort law that could potentially accommodate liability claims against the parent companies of multinational corporate groups for damage incurred due to their transnational subsidiaries’ activities (referred to as ‘foreign direct liability’ in legal doctrine). To this end, the potential legal grounds of fault liability and strict liability are assessed under Turkish law, with a particular focus on the duty of care, in comparison with the corresponding case law in the UK and the Netherlands. Mandatory human rights due diligence is also analysed with a view to proposing a new regulation in Turkish law. Lastly, the aspects of foreign direct liability claims related to private international law are assessed in order to answer the questions of jurisdiction and applicable law within the scope of a comparative legal study.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51607986995473,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ GARDNERS","offer_id":51607987192081,"sku":"NGR9783031293382","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/303129338X.jpg?v=1750966717"},{"product_id":"european-court-of-human-rights-and-constitutional-courts-book-marco-antonio-simonelli-9783031712678","title":"The European Court of Human Rights and Constitutional Courts","description":"This book investigates the relationship between the European Court of Human Rights (ECtHR) and national constitutional courts by providing a more general assessment as seen from the former’s perspective. This represents more than 3,000 rulings spanning more than fifty years, from the establishment of the Strasbourg Court in 1959 – when only three constitutional courts were active – to 1 January 2023, when there were more than thirty active constitutional courts in the Council of Europe’s Member States. This wide-ranging empirical study pursue several different goals. First, the book provides a quantitative assessment of the relevance of constitutional courts in ECtHR case law and presents weighted data on the frequency and chronological evolution of the citations, as well as individual statistics for each national constitutional court. Second, it assesses the extent of the rationalisation of constitutional justice systems conducted by the Strasbourg Court and defines the standards and elements of the right to a fair constitutional trial under Article 6 ECHR. The book takes the non-recognized States that emerged in the post-Soviet area after 1990\/1991 as examples, but also makes references to other non-recognized States. The book is written from a comparative perspective, giving room to authors from various States and non-recognized States (state-like entities) alike. Recent developments have led to the disappearance of three non-recognized States in the region. In this regard, the book may also be interesting as a source of information that has already disappeared or will probably soon disappear from the Internet. Further, the book is highly relevant for the remaining non-recognized States in the region, while also offering a source of inspiration for private law (including civil procedure) and investment law aspects concerning non-recognized States in general.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51680325566737,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":51680325763345,"sku":"NIN9783031656149","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ GARDNERS","offer_id":52152001200401,"sku":"NGR9783031656149","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/3031656148.jpg?v=1750773473"},{"product_id":"litigating-the-politics-of-human-rights-book-sonja-c-grover-9783031824623","title":"Litigating the Politics of Human Rights","description":"The cases analysed involve litigation concerning a disparate range of contemporary US culture wars  including equity in access to public services unrestricted by religious bias,  resistance to the teaching of historical facts relating to racial tensions in America including the so-called ‘critical race theory’ debate, the right of schoolchildren to exposure concerning a diversity of views, current USSC litigation about US university admissions policy that considers ‘race’ (ethnicity) as one factor amongst many in admission,  contemporary cases concerning the constitutionality of US abortion law grounded on Roe v Wade and the scope of State and indigenous sovereign powers  These contemporary culture war US landmark cases are then compared to similar cases in non-US jurisdictions and courts to consider in more depth the underlying core issues in these cases. The book highlights the risk to a democracy of recasting fundamental human rights litigation as essentially nothing more than the sorting out of political quagmires and cultural conflicts best left to the discretion of government rather than the courts. Then, the major risk is that constitutional controversies will increasingly not be decided by an independent judiciary but rather by self-interested politicians as the courts more often than not decline to weigh in on highly sensitive human rights controversies. A further risk is that instead such cases will be decided through a judicial majoritarian political lens rather than a largely apolitical consensus judicial opinion constructed by both philosophically left leaning (so-called liberal) and right leaning (so-called conservative) jurists.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51680540459281,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":51680540688657,"sku":"NIN9783031824623","price":0.0,"currency_code":"GBP","in_stock":false},{"title":"GB \/ NEW \/ GARDNERS","offer_id":52151889920273,"sku":"NGR9783031824623","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/3031824628.jpg?v=1751063837"},{"product_id":"tourists-consumer-contracts-and-private-international-law-in-china-book-zhen-chen-9783031879142","title":"Tourists, Consumer Contracts and Private International Law in China","description":"This book explores the intersection of consumer contracts and private international law, with a specific focus on tourists in China. The primary aim is to analyze how private international law addresses consumer protection issues, particularly for tourists, and to come up with legislative proposals to improve consumer protection in China. By examining current legislative provisions, case studies, and judicial practices, the book provides a comprehensive understanding of consumer protection in Chinese private international law and potential legal reforms to enhance consumers’ access to justice in cross-border litigation. The increasing globalization and mobility of consumers, especially tourists, call for robust legal frameworks to protect their rights across borders. While China does endeavor to protect consumers, the current regulations in Chinese private international law remain insufficient. Consumers, including tourist consumers, still encounter major obstacles in international civil litigation. This book highlights the strengths and weaknesses of China’s legal system, offering insights for potential legal reforms to enhance consumer protection there. This book is intended for academics, legal practitioners, policymakers, and students with an interest in private international law, consumer protection, and comparative law. It also offers a valuable resource for international organizations involved in consumer rights and tourism. By providing a focused analysis of tourist-related consumer contracts in China, it fills a critical gap in the existing literature.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51717811470609,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ GARDNERS","offer_id":51717811896593,"sku":"NGR9783031879142","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/3031879147.jpg?v=1751126186"},{"product_id":"scientia-iuris-book-luca-siliquini-cinelli-9783031519383","title":"Scientia Iuris","description":"Law’s regulatory reach has grown significantly over the past few decades. Yet, at the same time, law schools and legal professions in Western and Western-oriented jurisdictions have undergone an acute crisis. How is this possible? In this insightful and wide-ranging book, Luca Siliquini-Cinelli argues that these trends are in fact complementary manifestations of a single phenomenon—namely, that law is and will always be more capable of regulating social interaction without the experiential contribution of legal experts.     Siliquini-Cinelli contends that the separation of law’s regulatory function from legal experts is structurally linked to the former’s nature and operational dynamics as an intellectual artifact to be used for ordering purposes. As a product of the intellect, law is a matter of knowledge, not experience. In fact, Siliquini-Cinelli holds, law’s artifactuality voids experience, including that of legal experts, making it redundant. This explains how law can thrive as a regulatory phenomenon while the very places where future legal professionals are formed and those places where it is practised are in crisis.    To show this, Siliquini-Cinelli embarks upon a historical, philosophical, and comparative analysis of law’s artifactuality, focusing on the teaching, study and practise of law as intellectual endeavours, from the advent of juristic activities in the Late Roman Republic to current legal pedagogies, practices, and reforms in Civil and Common law jurisdictions. In so doing, Siliquini-Cinelli employs the Latin phrase ‘scientia iuris’ to explain why and how legal education and practice pursue knowledge at the expense of experience, and the serious implications this has for lawyering activities.    Moving beyond established narratives, Siliquini-Cinelli argues that ‘scientia iuris’ ought not be reduced to dogmatic analysis (scientia iuris as doctrina iuris). Rather, ‘scientia iuris’ denotes the knowledge of the law sought by all those who teach, study, and practise it, and which is actualised through a form of legal thinking and argumentation that moves along reason’s metaphysical, constructivist lines (scientia iuris as cognitio iuris). Thus, scientia iuris is not the prerogative of a few legal scholars; rather, it lies at the very core of Western legal education and practice, broadly understood.    The relevance of Siliquini-Cinelli’s original and interdisciplinary analysis is profound and far-reaching: the crisis that legal education and practice are undergoing is not an isolated, or accidental, event; it is a consequence of the very ways in which law has been taught, studied, and practised since Rome.       Endorsements ‘This richly researched book on the history of scientia iuris is a work on epistemology which argues that the legal model is highly problematic and will eventually be able to function without the intervention of jurists and lawyers. Such a thesis is based upon a very detailed knowledge both of philosophy and of the legal primary and secondary sources from Roman to modern times. The author is at home with Ancient Greek, Latin, French, German and Italian texts and this means that the research basis for the thesis not only is unusually profound – encompassing both the civil and the common law – but will make a major contribution to historical jurisprudence, to comparative legal history, to comparative law in general and to legal theory. This is legal scholarship of the highest order.’ Geoffrey Samuel, Emeritus Professor of Law, Kent Law School       ‘In this exceptionally robust and expertly-researched new book, Luca Siliquini-Cinelli presents a provocative thesis. He proposes that the experience of legal experts is redundant when it comes to the success of law as a regulatory framework. Oscillating between historical, material, philosophical and literary frames, Siliquini-Cinelli introduces what he terms ‘law’s artifactuality’. Law’s artifactuality as an intellectual phenomenon of social ordering is established through a comparative excavation of legal pedagogy and practice stretching from the Late Roman Republic to contemporary contexts to expose law as a product of the intellect. Law is therefore a matter of knowledge, not experience. Siliquini-Cinelli makes a sophisticated philosophical case for scientia iuris as a special form of knowledge that exists distinct from experience. This is at the core of the book in claiming that the current detachment of law from legal experts is a symptom of law’s essential and enduring artifactuality. This detachment is therefore incubated and internal to law’s essential nature rather than a consequence of the prophetic shadow of AI. This book is a vital and timely intervention in the current crisis gripping legal education and legal practice and their future relation with AI. The book is a stellar example of the profound importance of historical and philosophical thinking in law as a means to understanding contemporary phenomena in law. Siliquini-Cinelli executes his analysis masterfully and brings fundamental insights to the debate on knowledge and experience in law.’ Kimberley Brayson, Professor of Critical Jurisprudence, Leicester Law School       ‘This book is not for the faint-hearted or the narrow-minded. It is not for the narrow-minded as it paints on the broadest of canvasses, from the Late Roman Republic to the Middle Ages to the Methodological Legal Positivism that characterises modernity. It is not for the faint-hearted as it makes the bold claim that law does not need lawyers. The reason law does not need lawyers is that law is based on knowledge, not experience. If Luca Siliquini-Cinelli is right, then Oliver Wendell Holmes is wrong. The stakes couldnot be higher.’ Joshua Neoh, Associate Professor of Law, ANU College of Law       ‘[An] important book ... This thesis fills this void and connects these two principles for the first time.     Quod Omnes Tangit was initially introduced in Justinian's Codex Civil, while Tianxia Wei Gong originated from Liji, one of the books in a key series of works by Confucius. Liji is comparable to the Thora in the Old Testament and is considered as important as law in Chinese legal history. Both principles have undergone comparable developmental processes, with scholars contributing to their reinterpretation.     This book thoroughly examines the interpretations of individual scholars, with particular attention given to Liang Qichao, who is the only one to have mentioned both Tianxia Wei Gong and Quod Omnes Tangit. The book also provides an explanation for the original discrepancies in their concepts, particularly their methodologies in distributing and legitimizing rights.     This research will be of interest to legal philosophers and historians in both the Western and Eastern worlds, legal practitioners and policymakers, and researchers seeking to explain current events and explore fundamental differences between the East and West.","brand":"WoB","offers":[{"title":"- \/ - \/ -","offer_id":51728355361041,"sku":"","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"GB \/ NEW \/ GARDNERS","offer_id":51728355819793,"sku":"NGR9783031464690","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/3031464699.jpg?v=1750773368"},{"product_id":"same-sex-couples-comparative-insights-on-marriage-and-cohabitation-book-macarena-sez-9789402405446","title":"Same Sex Couples - Comparative Insights on Marriage and Cohabitation","description":"This book shows six different realities of same-sex families. They range from full recognition of same-sex marriage to full invisibility of gay and lesbian individuals and their families. The broad spectrum of experiences presented in this book share some commonalities: in all of them legal scholars and civil society are moving legal boundaries or thinking of spaces within rigid legal systems for same-sex families to function. In all of them there have been legal claims to recognize the existence of same-sex families. The difference between them lies in the response of courts. Regardless of the type of legal system, when courts have viewed claims of same-sex couples and their families as problems of individual rights, they have responded with a constitutional narrative protecting same-sex couples and their families. When courts respond to these claims with rigid concepts of what a family is and what marriage is as if legal concepts where unmodifiable, same-sex couples have remained outside the protection of the law. Until forty years ago marriage was the only union considered legitimate to form a family. Today more than 30 countries have granted rights to same sex couples, including several that have opened up marriage to couples of the same sex. Every day there is a new bill being discussed or a new claim being brought to courts seeking formal recognition of same sex couples. Not all countries are open to changing their legal structures to accommodate same-sex couples, but even those with no visible changes are witnessing new voices in their communities challenging the status quo and envisioning more flexible legal systems.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52089250218257,"sku":"NLS9789402405446","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9789402405446.jpg?v=1756906456"},{"product_id":"rule-of-crisis-book-pierre-auriel-9783319744728","title":"The Rule of Crisis","description":"This book analyzes emergency legislations formed in response to terrorism. Drawing on comparative law and empirically oriented methodologies, in this book the author provides a thorough analysis of how procedural due process is understood both in national jurisdictions and in the field of international human rights law. The book offers a suitable due process theory for civil matters in general, assessing the different roles that this basic international human right plays in comparison with criminal justice. In this regard, it argues that the civil justice conception of due process has grown under the shadow of criminal justice for too long.   Moreover, the theory answers the question of what the basic requirements are concerning the right to a fair trial on civil matters, i.e., the question of what we can and cannot sacrifice when designing a civil procedure that correctly distributes the risk of moralharm while remaining accessible to people with complex and simple legal needs, in order to reconcile the requirements of procedural fairness with social demands for justice. This book makes a valuable contribution to the field of civil justice, legal design, and access to justice by providing an empirically based normative theory regarding the right to a fair trial. The EU is a remarkable achievement of trans-national co-operation, given the history (including recent history) of national, racial, ethnic and religious hatred and con?ict preceding its creation. Although, as the book recounts, the institutions of the EU grew directly out of those of the European Economic Community, created in 1957 [1.20], the genesis of the EU can be traced to the sufferings of the Second World War and to the disclosure of the barbarous atrocities of the Holocaust. It explores the legal framework as well as key institutions and other actors along with the socio-economic context involved in interpretation, implementation, enforcement and overall promotion of fundamental labour rights in China. As a collection of chapters, it assembles comparative and mutually complementary perspectives and insights by distinguished scholars from China, Europe and the United States. With its broad perspective on implementation, the book discusses the most topical challenges to realizing fundamental labour rights in China. China was among the founding members of the ILO. With the regulatory approach of the ILO, fundamental labour rights have gained a new foothold as a key pillar in managing the social dimension of globalization. The development of fundamental labour rights protection in China can be viewed as part of a larger development within China’s domestic economic and social transition as well as its integration into the global economic system. While China has ratified four of the eight ILO core conventions, the challenge of effective implementation and enforcement in the domestic context remains. With its in-depth research on fundamental labour rights in the particular cultural context of the Chinese experience, this book studies Chinese labour law from multiple perspectives, at the same time examining the wider role of international labour standards in developing Chinese law and society. This volume is a remarkable enlargement of existing scholarship on international labour standards, on the one hand, and fundamental labour rights in China on the other. These chapters thoroughly analyse the legal and institutional framework for implementing labour law in China. Among the topics covered are fundamental labour rights including freedom from forced labour, prohibition of use of child labour andnon-discrimination. In addition, this volume benefits from socio-historical observations on the cultural logics that inform implementation of fundamental labour rights in China in which the history and current development of Chinese labour law are equally reflected with substantive depth.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52123149730065,"sku":"NLS9783319794532","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319794532.jpg?v=1757447040"},{"product_id":"same-sex-couples-comparative-insights-on-marriage-and-cohabitation-book-macarena-sez-9789401797733","title":"Same Sex Couples - Comparative Insights on Marriage and Cohabitation","description":"Regardless of the type of legal system, when courts have viewed claims of same-sex couples and their families as problems of individual rights, they have responded with a constitutional narrative protecting same-sex couples and their families.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52126972313873,"sku":"NLS9789401797733","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9789401797733.jpg?v=1757481718"},{"product_id":"aristotle-and-the-philosophy-of-law-theory-practice-and-justice-book-liesbeth-huppes-cluysenaer-9789400792920","title":"Aristotle and The Philosophy of Law: Theory, Practice and Justice","description":"The book presents a new focus on the legal philosophical texts of Aristotle, which offers a much richer frame for the understanding of practical thought, legal reasoning and political experience.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52133446353169,"sku":"NLS9789400792920","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9789400792920.jpg?v=1757530503"},{"product_id":"threads-of-natural-law-book-francisco-contreras-9789401780476","title":"The Threads of Natural Law","description":"The notion of “natural law” has repeatedly furnished human beings with a shared grammar in times of moral and cultural crisis. Stoic natural law, for example, emerged precisely when the Ancient World lost the Greek polis, which had been the point of reference for Plato's and Aristotle's political philosophy. In key moments such as this, natural law has enabled moral and legal dialogue between peoples and traditions holding apparently clashing world-views. This volume revisits some of these key moments in intellectual and social history, partly with an eye to extracting valuable lessons for ideological conflicts in the present and perhaps near future. The contributions to this volume discuss both historical and contemporary schools of natural law. Topics on historical schools of natural law include: how Aristotelian theory of rules paved the way for the birth of the idea of \"natural law\"; the idea's first mature account in Cicero's work; the tension between two rival meanings of “man’s rational nature” in Aquinas’ natural law theory; and the scope of Kant’s allusions to “natural law”. Topics on contemporary natural law schools include: John Finnis's and Germain Grisez's “new natural law theory”; natural law theories in a \"broader\" sense, such as Adolf Reinach’s legal phenomenology; Ortega y Gasset’s and Scheler’s “ethical perspectivism”; the natural law response to Kelsen’s conflation of democracy and moral relativism; natural law's role in 20th century international law doctrine; Ronald Dworkin’s understanding of law as “a branch of political morality”; and Alasdair Macintyre’s \"virtue\"-based approach to natural law.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52137186230545,"sku":"NLS9789401780476","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9789401780476.jpg?v=1757557218"},{"product_id":"supreme-courts-under-pressure-book-pablo-bravo-hurtado-9783030637309","title":"Supreme Courts Under Pressure","description":"Introduction.- Towards a Reform of the French Court of Cassation?.- Finding a Cure or Simply Relieving Symptoms? It offers in-depth analyses and discussions of topical and important issues in animal laws and animal welfare, and provides a comprehensive and comparative snapshot of some of the most important countries in the world in terms of animal population and worsening animal cruelty. Among the issues discussed are international law topics that relate to animals, including the latest WTO ruling on seal products and the EU ban, the Blackfish story and US law for cetaceans, the wildlife trafficking and crimes related to Africa and China, and historical and current animal protection laws in the UK and Australia. Bringing together the disciplines of animal law and animal welfare science as well as ethics and criminology with contributions from some of the most prominent animal welfare scientists and animal law scholars in the world, the book considers the strengths and failings of existing animal protection law in different parts of the world. In doing so it draws more attention to animal protection as a moral and legal imperative and to crimes against animals as a serious crime.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52137924034833,"sku":"NLS9783319800219","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319800219.jpg?v=1757559896"},{"product_id":"autonomy-in-the-law-book-mortimer-sellers-9789400791749","title":"Autonomy in the Law","description":"Autonomy in the Law considers one of the most important benefits of the rule of law. The book's underlying rationale is that one cannot place at the same starting point people who have been treated differently in the past because in this way one merely perpetuates a state of difference and, in turn, social gaps are exaggerated and social cohesion is endangered. Starting out with an introduction on the meaning and typology of affirmative action policies, the book goes on to emphasise the interaction of affirmative action with traditional values of liberal state, such as equality, meritocracy, democracy, justice, liberalism and socialism. It reveals the affirmative action goals from a legal and sociological point of view, examining the remedial, cultural, societal, pedagogical and economy purposes of such action. After applying an institutional narrative of the implementation of affirmative action worldwide, the book explains the jurisprudence on the issue through syntheses and antitheses of structural and material variables, such as the institutional recognition of the policies, the domains of their implementation and their beneficiaries. The book eventually makes an analytical impact assessment following the implementation of affirmative action plans and the judicial response, especially in relation to the conventional human rights doctrine, by establishing a liaison between affirmative action and social and group rights. The book applies a multi-disciplinary and comparative methodology in order to assess the ethical standing of affirmative action policies, the public interests involved and their effectiveness towards actual equality. In the light of the above analysis, the monograph explains the arguments considering affirmative action as a theology for substantive equality and the arguments treating this policy as anathema for liberalism. A universal discussion currently at its peak.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52139541201169,"sku":"NLS9783319223940","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319223940.jpg?v=1757569589"},{"product_id":"personality-and-data-protection-rights-on-the-internet-book-marion-albers-9783030903305","title":"Personality and Data Protection Rights on the Internet","description":"This book focuses on protection needs and new aspects of personality and data protection rights on the Internet, presenting a comprehensive review that discusses and compares international, European and national (Brazilian, German, Pakistani) perspectives.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52140353913105,"sku":"NLS9783030903305","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783030903305.jpg?v=1757574064"},{"product_id":"supreme-courts-under-pressure-book-pablo-bravo-hurtado-9783030637330","title":"Supreme Courts Under Pressure","description":"Introduction.- Towards a Reform of the French Court of Cassation?.- Finding a Cure or Simply Relieving Symptoms? The Hon. Michael Kirby AC CMG This splendid book performs the heroic task of introducing readers to the large canvas of the commercial law of the European Union (EU). The EU began as an economic community of six nations but has grown into 27 member states, sharing a signi?cant political, social and legal cohesion and serving almost 500 million citizens. It generates approximately 30% of the nominal gross world product. Out of the chaos and ruins of historical enmities and the shattered cities and peoples that survived those terrible events, arose an astonishing pan- European Movement.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52144922591505,"sku":"NLS9789400719286","price":0.0,"currency_code":"GBP","in_stock":true},{"title":"US \/ NEW \/ INGRAM","offer_id":52932535648529,"sku":"NIN9789400719286","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9789400719286.jpg?v=1757591198"},{"product_id":"human-law-and-computer-law-comparative-perspectives-book-mireille-hildebrandt-9789400794085","title":"Human Law and Computer Law: Comparative Perspectives","description":"The focus of this book is on the epistemological and hermeneutic implications of data science and artificial intelligence for democracy and the Rule of Law. It features revised papers that were presented at the Annual Conference of the European-American Consortium for Legal Education, held at the University of Parma, Italy, May 2014. This volume is organized in four sections, where the topic is mainly explored from a comparative perspective, and includes case studies. The first section covers theoretical issues. It offers an analysis of principles in shaping Dworkin’s theories about international law, a reflection on the role of procedural principles in defining the role of the judiciary, a view on the role of general principles in transnational judicial communication, a study on the recognition of international law from formal criteria to substantive principles, and an inquiry from the viewpoint of neo-constitutionalism. The second section contains studies on the role of general principles in selected legal systems, including International Law, European Union Law as well as Common Law systems. The third section features an analysis of select legal principles in a comparative perspective, with a particular focus on the comparison between European and American experiences. The fourth and last section explores selected principles in given areas of law, including the misuse of the lex specialis principle in the relationship between international human rights law and international humanitarian law, the role of the judiciary in Poland as regards discrimination for sexual orientation, and the impact of the ECtHR case law on Italian criminal law with regard to the principle of legality. Overall, the book offers readers a thoughtful reflection on how the interpretation, application, and development of general principles of law by the judiciary contribute to the evolution of legal systems at both the domestic and international levels as well as further their reciprocal interactions.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52145701650705,"sku":"NLS9783319191799","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319191799.jpg?v=1757594769"},{"product_id":"law-liberty-and-the-rule-of-law-book-imer-b-flores-9789400793828","title":"Law, Liberty, and the Rule of Law","description":"This book examines the core concepts of the rule of law, discussing the balance of powers and exploring the relationship between rule of law, human rights and separation of powers as well as the interplay between rule of law, constitutionalism and democracy.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52146209063185,"sku":"NLS9789400793828","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9789400793828.jpg?v=1757596952"},{"product_id":"racial-justice-policies-and-courts-legal-reasoning-in-europe-book-cristina-hermida-9783319535791","title":"Racial Justice, Policies and Courts' Legal Reasoning in Europe","description":"This volume looks at how courts and the police handle racial discrimination in Europe. The chapters show that beyond legal technique, neither the legislators nor the judges escape from their own emotions when responding to racial discrimination. But, as the authors point out, emotions are not always negative. They can also help in a positive way in judicial interpretation. The study profiles five countries: Germany, UK, Estonia, Portugal and Spain. Each of these belong both to the European Union and to the Council of Europe. Coverage examines the responsibility of the public powers, more specifically of the legislative and judicial power, both of the police and of the judiciary, in persecuting racist behavior. In addition, the authors also consider the increase in racism in groups of citizens. The authors argue that racial justice is a proactive reinforcement of policies, practices, attitudes and actions that lead to equal access to opportunities for all. The central question deserving the attention of the contributors concerns the degree in which judicial exercises in practical reasoning may amount to forms of judicial usurpation of the legislative function by courts. Since different views as to the nature and scope of legal reasoning lead to different degrees of tolerance regarding what should be admissible to courts, that same nature and scope is thoroughly debated. The main disciplinary approach is that of general jurisprudence, but the contributions take stock of other disciplines in which judicial activism has been addressed, namely positive theories of judicial behavior. Accordingly, the book also explores the development of interdisciplinary dialogue about the theme.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52148800258321,"sku":"NLS9783319185484","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783319185484.jpg?v=1757604688"},{"product_id":"rule-of-law-in-comparative-perspective-book-mortimer-sellers-9789048137480","title":"The Rule of Law in Comparative Perspective","description":"This volume compares the different conceptions of the rule of law that have developed in different legal cultures. In various contributions by renowned academics and high judges demonstrate the serious impacts of supranationality on the EU member states and even on third countries which are connected with the EU by international treaties. It becomes clear that primacy of EU law, the most significant expression of supra-nationality, collides with national sovereignty as anchored in the national constitutions. The studies clearly show that most member states do not fully deny EU law primacy but are aware of the need to find an adequate balance between the supranational and the national orders. The result from the analyses of the authors from various European countries is that the upcoming constitutional paradigm is “constitutional identity”, a concept established by jurisprudence in Germany, France, Czech Republic (without being named so) and debated also in Poland which, herself, denies supranational impact on the national Constitution entirely. Studies on selected EU member states clarify the specific national approaches towards the limitations of their sovereignty as developed by the constitutional jurisprudence (Poland, Czech Republic, Hungary, Romania, Italy, Germany with comparative references to United Kingdom and France). It is illuminated that traditionally strong sovereignty concepts (UK, France) are considerably relativized and functionally opened towards the integration challenges. Basic issues are furthermore reflected, such as the supranational impact on the State’s power to reform its Constitution, the relation of national and constitutional identity and the national and supranational perspectives of identity. The book also includes Europe beyond the EU by research on the supranational character of association treaties (from a Ukrainian perspective) and on the Europeanization of a third country preparing EU membership (Albania).","brand":"WoB","offers":[{"title":"GB \/ NEW \/ INGRAM","offer_id":52151471505681,"sku":"NLS9789402413557","price":0.0,"currency_code":"GBP","in_stock":true}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9789402413557.jpg?v=1757613463"},{"product_id":"economic-development-and-human-rights-in-contemporary-sub-saharan-africa-book-ines-kajiru-9783031813993","title":"Economic Development and Human Rights in Contemporary Sub-Saharan Africa","description":"This book explores the connections between economic development and the protection of human rights. Drawing on experiences from Sub-Saharan African countries, the book demonstrates how various economic activities impact the protection of human rights in Sub-Saharan Africa. The book explores the core concepts and principles, theory and practice, accountability mechanisms, and key challenges to the protection of human rights in Sub-Saharan Africa in the era of global economic development. It also shows the ways in which human rights law and development can be used to obtain relief for the victims of environmental degradation or adverse effects of climate change in Africa. In addition, it places emphasis on development and economic policies to highlight the pros and cons of using human rights-based approaches and its significance in the context of economic development and human rights in Africa. The book is divided into three parts: Part I focuses on the conceptual and theoretical foundations of human rights and economic developments in Africa and covers essential concepts, historical perspectives, the African human rights framework, human rights litigation, and comparative approaches. Part II addresses the intersection of economic development and human rights in Sub-Saharan Africa, including human rights and individual liberties in the context of economic empowerment of citizens; human rights and the development of regional economic integration; human rights and economic independence; human rights and the economic empowerment of vulnerable groups; and human rights and cultures. The third and final part focuses on challenges and prospects of human rights and the economy in Sub-Saharan Africa by taking a closer look at human rights and globalization, cultural relativism, science and technology, state sovereignty, and governance structures and systems. It critically examines the effectiveness of mediation, arbitration, restorative justice, collaborative law, and online dispute resolution (ODR) in settling disputes or conflicts, while also demonstrating the benefits of ADR and multi-door courthouses (MDCs). The book provides a concise introduction to the resolution of disputes or conflicts in Africa prior to the advent of colonial rule. It suggests that a ‘legal transplant’ can also take place from a less complex society to a more complex one, contrary to the general belief that legal transplants usually proceed from a more complex society to a less complex one. The book aims to help people understand ADR mechanisms and the advantages of settling disputes using means other than litigation. It presents Traditional African Methods of Settling Disputes (TAMSD), Early Dispute Resolution (EDR), arbitration, negotiation, ODR, collaborative law, restorative justice, conciliation, ombuds, and early neutral evaluation as viable alternatives. It also highlights the need for clinical legal education and effective messaging that highlights the benefits of ADR compared to traditional litigation. In turn, it analyses the use of ADR, especially mediation and collaborative law, to settle disputes in criminal law, restorative justice, employment law, and business and human rights due diligence\/violation cases. Further, the book demonstrates that criminal matters are now under the scope of ADR via Restorative Justice Door. The book discusses the skills, techniques, and relevant statutory frameworks for each field of Appropriate Dispute Resolution and provides national and international examples of the application of the relevant principles. Addressing the fields of Appropriate Dispute Resolution (ADR), criminal law, civil law, business management, psychology, employment law, humanresource management, and African studies, it will appeal to a wide readership.","brand":"WoB","offers":[{"title":"GB \/ NEW \/ GARDNERS","offer_id":52152589713681,"sku":"NGR9783031574757","price":0.0,"currency_code":"GBP","in_stock":false}],"thumbnail_url":"\/\/cdn.shopify.com\/s\/files\/1\/0784\/4072\/6801\/files\/9783031574757.jpg?v=1757617162"},{"product_id":"comparative-perspectives-on-the-right-to-privacy-book-sohail-aftab-9783031455773","title":"Comparative Perspectives on the Right to Privacy","description":"This book focuses on devising a comprehensive protective mechanism for the right to privacy in Pakistan. It argues that the existing legal regime lacks an effective remedy for victims of privacy violations and emphasizes the need for comprehensive legislation to safeguard this crucial right. Pursuing a multidisciplinary approach, the book thoroughly explores the issue of media intrusions into people’s privacy through thematic media content analysis and highlights the significant impacts of these intrusions on victims’ lives. In the process, the book addresses various conceptual aspects, their relevance, and their implications for privacy-related disputes during adjudication. Recognizing that theoretical underpinnings alone may not be sufficient to create a legal regime “from scratch,” it explores the enforcement of the right to privacy under the European Convention on Human Rights (ECHR), as interpreted and enforced by the European Court of Human Rights (ECtHR). The book subsequently goes beyond exploring international law by analyzing the impact of media-and-privacy cases on privacy protection in two major member states: Germany (a civil law jurisdiction) and the United Kingdom (a common law jurisdiction).
