The criminal justice system encompasses the most severe instrument at the state s disposal in times of peace. For this and many other reasons, overuse of that system is a serious matter. Containing an extensive collection of expert knowledge, this volume intends to expose legal possibilities, good practices and the many challenges that lie ahead when attempting to prevent overuse in the criminal justice system.
Piet Hein van Kempen is full professor at the Faculty of Law of the Radboud University Nijmegen, and holds the chair of Criminal Law and Criminal Procedure Law. From 2007 till 2011 he also held the chair of Human Rights Law. Both chairs belong to the Centre for State and Law(Centrum Staat en Recht). He also sits as a part-time Justice in the Court of Appeal of 'sHertogenbosch, The Netherlands, and is furthermore Secretary General of the International Penal and Penitentiary Foundation. He specializes in substantive criminal law and criminal procedure law, in criminal law developments in the European Union, and in international and European human rights law, including the rights of suspects, detainees and prisoners. He teaches courses and conducts research in all those areas of attention. He is a member of several Boards and Editorial boards. From 1991 till 1995, he studied Dutch law, majoring in criminal law, at the University of Tilburg (BLaw, MLaw). He was granted the highest obtainable distinction for both phases of the study programme. In 2003, he obtained his doctoral title with his PhD thesis 'Reopening of Procedures after Judgments by the European Court of Human Rights. Redress of violations of the European Convention on Human Rights in closed criminal trials as well as in closed civil and administrative cases'. Before obtaining his PhD-degree, he worked as a lecturer in Criminal Law at the University of Leiden, as a researcher at the T.M.C. Asser Institute for Public and Private International Law in The Hague, and as a post-doctoral researcher in Procedural Law at the University of Tilburg.

Maartje Krabbe is a researcher and lecturer at the department of criminal law and criminology of the Radboud University in Nijmegen, The Netherlands. From 2004 to 2012 she worked at Maastricht University, where she taught tort law, substantive criminal law, criminal procedure, comparative criminal law and international criminal law. During this appointment Krabbe carried out several research projects in the field of international criminal law. One of these projects resulted in the Ph.D. thesis Excusable Evil: An Analysis of Complete Defenses in International Criminal Law (Intersentia, 2014), which was supervised by Prof. Andr� Klip and Prof. Gerard de Jonge. Krabbe's research interests lie, among others, in the area of complete defenses, criminal liability, international criminal law and comparative criminal law.
